Spouse Credit Card Debt

Hi,

I live in Michigan and after researching found out that credit card company cannot hold me liable for spouse cards. They are not jointly held. I settled ones in my name and am now starting hers. If they sue her, they cannot garnish my wages but can go after joint checking account. I set up new account in my name only. Could put lein on home but underwater and do not plan on selling anytime soon.

Am I forgetting anything?? If they sue, what would they get? She does not work and my income cannot be garnished. I am self employed.

I think you are good. You are right that they can not come after you for her debts, but they will try. They will tell you they can but then won't take action because they know they can't.

I'm sure you will be able to settle prior to it getting to a lawsuit situation, but just remember that judgements can last a very long time and in some states can be renewed to last even longer. But with her situation, I would say they will be happy to settle. Good luck and let us all know how it goes.
