The worst thing about my situation is that $700 of the money owed was because of interest build up. And if i were to pay it in full that would be more than 4x the amount that I should have originally payed. I was under the impression that the card was paid off years ago. (but im not sure thats going to hold up in court without evidence which is impossible to provide) How hard is it to reach a settlement in court? Or would I have to call in for help with another company. Im just so overwhelmed by my situtation, this is all new to me and I never thought it would have ever come to this.
Any information or advise would be greatly appreciated. Thanks in advance

Call the attorney....keep calling if they dont return calls and try to settle. And answer the summons.

jason, you will have to answer to the summons within the 30 days, else they may win a default judgment against you. You can reach an out of court settlement with them. However, you will have to answer to the summons first. Whatever you agree to pay get the settlement agreement in writing.

I talked to the third party and we were able to reach a possible payment plan. But they are insisting that i pay an additional 500 dollars on top due to 'court fees'. I don't understand where this extra money is coming from. I've been trying to contact Capital One by phone but I've have been on hold from a representative for HOURS. It's like they are avoiding trying to talk to me. I'd rather much cut out the middle man and try to pay the debt in full than deal with those people.

Capital one doesnt want to talk to you....they have assigned your account to a third party under contract. In your cardholder agreement,you agreed to all court and legal fees...so far they have paid the costs for filing suit agsainst you, paid the process server and whatever costs off reseaching and doing paperwork in their office.
