Hello All!
I need some Help!...I got a letter from a Law Firm that I am being sued for an old Credit card..(Bofa)..It is on behalf of FIA and the law firm is Blatt etc....(In Illinois) I originally got the card in Calif and now live in Ill. Can they garnish my income if I am a 1099 employee?...Should I contact the law firm and try to work out a settlement?...Do I send the request for "Debt Validation now ? or after I receive a Summons?..(Have not got 1 yet)..It is now listed as a "contract complaint" at the County Clerk..Thanks everybody for the help.....Just trying to find out how I proceed with this!..Thanks Again!...


Hi there,
If you're a 1099 person, chances are that you are considered to be self-employed, as the company you are working with is not taking taxes out of your income. So based on that, probably not, as the only way this could happen would have to be by court order and since you're not technically an employee of the company, they would not have to comply with a court order. Could they go after you? Yes.

Can you tell whether they have already sued you or are going to sue you? if they haven't sued you still now, you should immediately send in a debt validation letter to the law firm. This will stop them from suing you. They will have to validate your debt first before they can continue with the collection process. You can use the sample debt validation letter available with this community at http://www.debtconsolidationcare.com/letters/sample6.html . Send the letter through certified mail, requesting a return receipt.

Hi SC,
Thanks for your reply!...I actually have 2 separate issues with this law firm (Blatt.....) The first is on behalf of FIA card sevices...They have filed a "CONTRACT COMPLAINT" with the County Clerk. There is no court date listed and I have not received a Summons...This was filed on 5/21/2010...Should I send them a Debt Validation letter on this one? Or is it too late?..(If late, should I contact Blatt and attempt to settle?)

Regarding the 2nd issue, I received a letter from Blatt that a lawsuit has been filed and that they are representing Livingston Financial..There is no information with the County Clerk regarding this one...Should I send a Debt Validation letter for this one?...Thank you so much for your help...
