Capital 1 put a judgement on me, I was served, but didn't respond, I thought it was just a scare tactic, the summons looked fake & there was no court date on it. Then I got the intent to garnish wages letter, I'm unemployed, Ironicly I call to work out a payment plan on the same day I should've been in court. "Ken" told me I needed to pay at least 10% then I could start regular monthly payments, I don't have the money, & told Ken I'd have to call back, which I did, now Ken said I could pay 5% the first month & 5% the second month, then $100 a month there after. He pushed to get my bank info which I said I didn't have & needed to call back. I called back & was transfered to "Ashley" , She said Ken didn't have all the info for such payments & needed to know all my info before they'd agree to such payments, I really didn't want to tell her anything, she got snotty & said she was trying to help me, (yeah right), she got me confused with all her legal talk & I told her that I was married, she then wanted to know all about him, where he works, mortgage payments, etc. I didn't want to tell her & she got all pissy & said " we can't garnish his wages in Mn" she then said she had to discuss the payment plan with capt 1 & would get back to me, of course she never did, was she telling the truth about not being able to go after my husband under Mn law? I know all she really wanted was bank info, my husbands name was never on credit card agreement & my name is on Nothing but the credit card, my name is not on the mortgage, or the cars. we don't even have a joint bank account. All I have is $35 in a savings account. Can they go after him? Or was she telling the truth?

Well that's good, but why would she want to know all the info about him? She said something like" we have your ss# & I can find out all your bank accounts". I felt like saying " well what the F are you asking me for if u already know it all" I know they will find it but if they'd rather have the $35 then a $100 so b it, The only thing I can figure out is that they saw my ss# on our tax return. We do file jointly to get a bigger refund. Maybe they thought I was hiding $. I'm not. I don't have any to hide. I havent worked a real job in 20 yrs. I see that the SOL in Mn for a judgment is 10yrs. I'm assuming that mean they can garnish my savings repeatly over that time? I'm just worried that they will go after him because I have no money or assets to put a lien on
