Should I settle with Arrow Financial?

Hello! I am in the process of being sued by Gamache and Myers on behalf of Arrow Financial Services. I have hired an attorney and have received advice from him and am not sure that I agree. If anyone can help I would appreciate it. I received a summons for court and hired an attorney. My attorney sent them a letter that more or less said validate the debt and I am authorized to offer you a sum of $X which was about 65% of the original debt and about 48% of the current debt. Their attorney wrote back and said they could not provide original signature of the debt but he didn't feel he needed it. He offered to settle for $500 more than what I had offered. My attorney said while he doesn't agree with the fact that they do not need to provide the signature he felt the settlement amount was fair and that I should just go ahead and pay them off. I am unemployed currently drawing the last month of my umemployment benefits and still jobless. My husband is a struggling small business owner. We have managed to go a month behind on other bills to save up what we had offered to pay them but it will be hard for us to come up with an additional $500. Still questioning whether I should really pay it off if they can not provide signatures of the alleged debt????? PLEASE HELP IF YOU HAVE ANY ADVICE!! THANK YOU

well a couple of things.first tell this ambulance chaser you call your attorney to motion to dismiss with prejudice.you see ARROW,and anybody who sues for them are bottomfeeders that have no legal right to collect at all.their lawyers response to the validation request speaks volumes.second if the ambulance chaser won't do that,then fire him for incompetant representation.then register and PM skydiver.let me tell a story here.a moderator here by the name of SHAZZERS had a default judgement vacated,and dismissed with prejudice thanks to skydiver.you see ARROW is a blight on not only the collections industry,but to every working person period.your case should be dismissed,and skydiver can help there,but first let your lawyer know your position.they are not going to validate.therefore you want to motion to dismiss with prejudice.do not bother with him further if he tries to talk you int settling a debt that as you said you are not sure they have legal right to collect.

Ok now to follow up and get even more advice. My attorney filed a motion to dismiss the case. Gamache Myers is obviously refusing so now I have about 14 pages of questions to fill out. The papers are Plaintiff's Reqeust for Admissions, Plaintiff's First Interrogatories and Plaintiff's First Request for Production of Documents. I and my attorney have both requested for validation of the debt. While I agree to owing the CC co. I have no validation that I in fact owe this collection co. What to do now??? Thanks for any help and advice.

I can help you with those Discovery Requests. I am not an Attorney, but I have fought two personal lawsuits on my own. I am familiar with the Consumer Protection Laws, especially involving Debt Collectors. I can't legally advise, but I can advise what I would do if in a given situation.

Please contact me immediately at deleted..pm so that I can start to help you on those Discovery Requests.

If I were you, I'd tell this Attorney, thank you for your help so far, but for right now, this isn't working. Your Attorney fees will continue to eat up your limited resources. I don't charge anyone for my help. I have documents, letters etc. I have a letter that I think will help with your Plaintiff's Attorney, while you Answer the Request for Admissions, Interrogatories and Production of Documents.

I will watch for your email. When did you get served the Discovery Requests? Most states allow 30 days for a response. At any rate, the clock is ticking, and stressing won't help you, but I can, and promise to do my best if you let me!

I am not sure how to get in contact with you. I would love to chat so I can hear what you think. I have until Aug. 2 to return the papers to the Plaintiff. Of course my attorney gave me a week to get it back to him and I have surpassed that partially due to his lack of communication. I did not feel like I should fill them out when they have faliled to validate the debt.

Sorry but I can not figure out how to email you. I am very new to this site and am not having much luck figuring it out. I would love to chat with you and as you noticed my time is running out. I have until Aug. 2 to return the paperwork to the Plaintiff. THanks
