lost a 3/4 million $ business in dec.06, actually negotiated wiyh lending bank to take all my investment/retirement property to "let us off the hook" for the amount owed( along with business in question of course, which was real property). They told me at the time that they would cover all the debt associated with this business. I found out 4 months later ( when contacted by the credit card companies that this was not happening). I then paid a debt relief company almost $12k before I quit as none of my creditors were being paid. My husband had to take an early retirement from his job as a firefighter of just shy of 20 years due to heart and blood pressure problems (can't imagine why!!!!) and I had to come up with thousands to buy him an early retirement so he could collect his retirement pension. Husband mostly out of work (handyman) due to economy and I am not employed at this time. Have about $100k in equity in my home of 22 years, two older paid off vehicles and a pension of $1700 amonth. House payment is 1100. a month. What can they do to me when I go to court to answer this summons? This is just one of a number of creditors (collection agency for the creditor).Any help, GREATLY appreciated.....worried sick

Did you get this agreement in writing?

Don't panic. They will do nothing serious to you as this is only a civil case. You will simply be questioned on this debt. The judge may ask you whether, and how you intend to settle this debt. Then the court will settle the judgment amount, which you will have to pay. The judgment will be entered on your credit report, and will hurt your credit for 7 years.

The creditor, if he wins the judgment can also either garnish or put alien against your property. Now, you won't be able to sell your property till you pay off the lien. Only when you pay the amount you owe, may the lien be removed.
