You have to be sued for them to garnish your wages. Did you receive a summons? Did you answer the summons? If not, you could have the judgement set aside for lack of service.
What state are you in?

I attempted to explain to him that at the time I had insurance and obviously the hospital did not properly bill my insurance. However, at this aprticular time I am in a severe financial hardship. I am a server at a restaurant and this is our slow time of year and it is hitting me so very hard. So much so that I am behind in rent and I have a court date for the end of the month. Hi, Colleen,
Since this is a bill from years ago, you need to check the statute of limitations in your state. You can check out the Fair Debt Collection site and they list states and time on statutes. These laws prohibit a collector or even a creditor from coming after you after a specific period of time. If its beyond the statutes, they can't collect, but you'll have to write them a letter and dispute it on that basis.
Whenever you received a collection bill, it's always better to address it in writing in order to preserve your rights under the Fair Credit Billing Act. Debt Collectors are fully aware of this.
Is your court date for rent or the hospital bill? Did you answer the summons and complaint? And who is suing you? Is the hospital or debt collector garnishing your pay? Under State statutes, a percentage of your assets and pay are exempt from garnishment. If you provide more information, maybe we can offer some solutions. As a legal analyst and retired banker, my family and I have been helping people with these kinds of problems for over 20 years.
Do you have legal aide in your area? They offer Free or low cost legal services based upon income.

SARA - your comments are highly misleading. SOL does not mean that nobody can collect on the account. when someone owes a debt (this is generally speaking and not referring to the OP's situation) you owe it until you pay it off. expiration of SOL means only that a collector cannot take legal action against you for it. bottom line is that they CAN COLLECT on an SOL account.

She also doesn't seem to understand the TOS, as I have asked her numerous times not to solicit her website, and also sent her a polite PM asking her not to solicit, yet she continues to do so. Therefore, It's obvious to me her purpose at this site, not to give accurate replies, but to solicit her website.
