June 15, 2010 I received a letter stating that I owe $30.56 to BMG Music Service. I have never had an account with this company nor have I ever heard of them. I called NAFS and omg the woman was super rude and flat refused to provide me with any information stated that the debit has to be paid and will not be removed from my credit report.
How did these people get my personal information and now has in turn filed an illegal collection claim against me. What can I do to have this removed? I have already filed a dispute.


Send them a debt validation letter through certified mail, requesting a return receipt. In the meantime, pull a copy of your credit report to check if this collection agency is listed there. If you see the collection agency listed on your credit report, send dispute letter to credit bureaus. Send this letter immediately after you get back the validation return receipt.

As a result of this the collection agency is put in a time crunch. Whenever a dispute is filed by the debtor, the credit bureaus notify the collection agency for verification of the debt. Now, the collection agency will have to verify the debt with the credit bureaus within 30 days. However, before the collection agency can verify the debt with the bureaus, they will ave to validate the debt with you. If they fail to do so, they will be in violation of Fair Debt Collections Practices Act. Moreover, if they fail to verify the debt within the 30 days, the credit bureaus will remove the item from your credit report.

You can also file a complaint with your regional Federal Trade Commission Office as well as the Better Business Bureau against NAFS in the state where they are doing business. Send them copies of both and remember to keep copies for your records. That should help put a stop to the collections.
