Lakota Cash – Are they licensed to operate in all states?

I took out a loan with Lakota Cash and enrolled in a debt consolidation company. LC sent a wage garnishment to my job and my HR department told me they had to honor the wage garnishment. I had to have LC fax over a form to stop the wage garnishment once they saw I was in the debt management program. My question is: Does LC have legal right to garnish my wages? … I live in Houston, TX.


What state are you in?

What they actually did was impose a "wage assignment", the good news is this, you can revoke it at any time and your employer must honor your revocation. Shoot them an email which states that you revoke their right to any wage assignments you may have signed, then show a copy to your employer, make sure you date it.

A garnishment can only be obtained with a court order, and due to the fact that Lakota Cash is located on an Indian Reservation I rather doubt they are licensed to lend in your state. CLICK HERE to find out how to deal with illegal lenders.

Lakota Cash can't really do this, especially if you never took a loan out, except somehow they obtained your information and my best guess is from another illegal Internet lender, that is why it's important that you deal with this.

I did receive a loan .. But Lakota Cash have my information from my debt consilidation company. They were still trying to garnish my wages. Once the debt consolidation company faxed over my paperwork they canceled the wage garnishment. I will submit paperwork to my payroll department so prevent them from doing that again. I always believed you needed a court order to garnish someone's wages.

I do hope you realize that due to the fact Lakota Cash is not licensed in your state this won't be the end of your dealings with them. You may be in a debt consolidation program, and they may tell you or your program director they will agree to accept payments, etc., but they will harass you after everything is said and done, for more money, they also can not be trusted with your personal account information. I am just letting you know, I have read other members have the same problems with this payday lender.

It would be in your best interest to close that account you can make payment arrangements via the mail with money orders, if you read the link I gave you above it will explain how to proceed with illegal lenders.

If you take a loan out with a online payday financial you do a e-sign. Which is technically YOU signing your name over the internet. Just because you did it over the internet does not mean they are going to just give you the money and not expect anything back. Maybe you should think about taking a "PAYDAY LOAN" out next time. Most payday loan companies have terms and conditions and loan agreements READ THEM NEXT TIME!
