I received a phone call from them (Erie Mitigation) today, and I am almost certain that this company works in tandem with Lighthouse Recovery Associates. They insisted they were permitted to call me at work even if I request that they don't, and they were also insistent that they were permitted to ask for my supervisor and HR department to verify employment and ask about wages garnishes. It sounded ALOT like Susie from Lighthouse Recovery, who has contacted me about tendollarpaydayloan.com (MTE financial). I got this information after repeatedly asking her who she was representing - and at first, she said Wachovia (my old bank). I said: "Wachovia??" and she finally stopped the lies and said she was representing tendollarpayday. I live in MD, so I proceeded to explain that these loans were illegal, and that I've paid the principle over and over again in fees by rolling the loan so many times. Our AG has actually tried to sue MTE financial many times, but has had no success since they refuse to show up for court dates.

She finally said she was going to hang up and get the information herself for my supervisor, so I gave her my HR fax # and name. I feel like I caved and shouldn't have done that, but I was nervous that they would start calling around to reach my boss - I'd rather them do some generic information gathering with HR instead of my boss. If they do fax something to my place of employment and make attempts to reach my boss, do I have any recourse since I specifically told them they were not permitted to do so? She kept saying the conversation was being recorded, which made no sense to me at all.

File a complaint with the FTC and your attorney general, they are in violation of the FDCPA and could be subject to a fine for not complying. You need to send them a wage assignment revocation, then date it, print it out and take it to your payroll department. They can't "garnish" your wages without a court order, but a wage assignment is voluntary and you probably signed it when you obtained the loan, just revoke it, it's as simple as that. You REALLY need to file that complaint asap!

I just got a call from Daniel Ballard who says he is from Eire Mitigation group LLC. He has my old checking account about an account with M1y direct payday loan. He says the original amount was $250.00 and it is now $450.00 but if I gave him my account info he would let me make $150.00 payment arrangements. If I did not do that he is sending over a verification of employment to my employment. Oh, and he called me at work and when I asked to call him back he would not give me his phone #. I told him I had not received notice and I was not giving out any of my info until I researched this. He finally gave me the number and said I could research it all I wanted.
Should I set up pmt arrangements? I made several pmts on the account with M1Y till I could not afford it anymore and did close that bank account-Is this just a threat?

Can you give me more detail on how to revoke the authorization? I'm going thru the same thing. I've got several trying to garnish my wages.
Thanks,
Kathy in TN
