First Legacy Asset Management

A person by the name of Joe Birsch from First Legacy asset management left a message on my voicemail saying that if i dont settle my debt by 3pm that day, that i will be arrested for bad check. I then called the number he left and said that they will settle for $1000 since the original debt is $2500..he proceeded that if i dont pay this i will be arrested at work. So i was terrified and called my father to ask for help, i then paid $1000 that day. He promised that i will receive a letter confirming the payment, but it has been over a month now, and i never did. I then told my wife about this and she then said that it is not possible to get arrested over a debt, and she then called this company asking for a letter to validate the debt, and information on how much the original loan was and original creditor. Up to this day, there is nothing, she then proceeded to call this company and the person who i spoke with kept on yelling at her and kept telling her that in california, returned ACH is considered a bad check. MY wife did her research and found out, it is not possible at all. She filed a complaint with FTC and BBB but still no response or refund. We are asking for $700 refund since the original loan amoutn is on $300. My question is, who should we contact to get this complaint going and get some answer....the company is located in New York (BTW my wife called Consumer Affairs in NY and they are not licensed) and we are located in CAlifornia.

This is a scare tactic used more and more nowadays to bully innocent people to pay a debt that possibly is not even theirs. As in this case you already shelled out $1k to a possible fraud attempt.

First you need to recall if you ever took a loan with this so called company and verify if you paid them what you borrowed. If the company turned out to be non legit or not licensed then you need to get that ACH transaction disputed ASAP with your bank. You might be able to recover your money. My question is how did they state you owe $2500k on and settle for $1k debt, was this from fees. That was a clear red flag right there:(

I had the same call for this company, last week and whn I asked for validation of the loan he got very defensive. i told hiom tha i will pay it if he can show me proof and agin he got very upset and started yelling at me, tha if I don't pay he I will be charge from check fraud. Well today I got a call from some name Roger Lewis say that he need to swerve me some papers and I migh evn get arrested at my Job. What can I do to gt these people to leave me alone or even find out if theya re legit.?BTW my cut off is 1:00 p.m today.

You should NEVER admit to owing a debt to a voice on the phone, tell them you will only respond to a letter of collection via the mail.

Thanks, i tried getting a letter from hthem,but he said it was too late. Now he has some guy calling me and sayin that he needs to serve me some paper at my job. he claims he was calling me out of courtesy and did not want to embrass me at my job, but if i call the compay which is First Legacy asset management, he could probably drop it. What do I do about this? they are constanly calling me now and will not send me any info to validate this. frustrated!!!!

Send them a cease and desist contact with you. Problem is, if they are trying to collect on an illegal payday loan I doubt they will abide by it, you may need to file a complaint with the FTC. They are probably just feeding you a bunch of BS, trying to scare you into giving them money. Looks like there are numerous complaints against them already for illegal practices. I would go ahead and file a complaint. Look up your state laws on civil procedure, there may be a law that states a process server can't serve papers at your place of employment, it depends on your state.

I rec'd a call from this company and they stated that they do not work with credit debt solution companies and they expect payment by end of this month. if i don't they will file fraudulent check charges and sue me. Any response to this i would really appreciate. im scared and I don't know what will happen.

again humanoid stupidity.they can't sue you and charge you with a crime.he threatened both.file a police report for the call.then use either the phone number you have,or the co name to file AG,and FTC complaints.then ignore him.he can't do a thing except call,and be stupid.

well ~ refused to give them info over phone...they said I committed fraud over stste line with a sister and one called about serving papers...nothing in writing...today I tried tose my debit card and it said do not honor...concerned that they may have blockrd my checking funds...this is not my loan and ~ never signed for someone else...if they blocked my acct...~ will sue...is the weekend and bank is not open

That is my name and dob now you have a law suit on your hands you idiot. I can track you by your IP address. You can not post my dob on a web site and get away with it. I have legal remedies to you scum bag. I run a clean business and we employ a variety of people of all races and backgrounds we have a job to do and if it includes filing a law suit against you for not paying your debts sorry about that but a simple phone call to us could have prevented that. If people borrow they have to pay. We only ask for what is owed nothing else. So stop living off the system and become a contributing member of society. Oh by the way I will be filing a federal complaint for releasing my personal information on this low- life blog.. See you soon. If you people on here look into debt consolidation you may have a new outlook on them look on ftc.gov or call any of your state attorney generals and ask them about debt settlement or debt consolidation see what they say and then keep listning to these people on this

hey paul call me at deleted..pm. Keep giving people this advice. We do send every account out for legal that we say we do, just follow up with some of the earlier people you advised on this blog. I hope they are happy with your advice...

Is this company in NY? I just checked and if so, they aren't licensed as they should by by NY state law. http://www.nyc.gov/html/dca/html/licenses/license_check.shtml

Roger Lewis 03/17/11, calls my work his number 877-615-3289 x 701, voice mail says he's from State of CT and would like to set up a time at my home or work place that he has papers to serve me to appear in court. I didn't return the call, however I know someone else did. They wanted us to call another number to setup a payment arrangement..........This is totally I scam. I get harrassed all the time from these people at work and wish it were stop. I just may go to the police and file a report today....this is riduclous - its almost like stalking person. Called back 3/18/11 now he gives a listing of 4 other companies that holding my account delinquent. Give me a break - They won't send documents providing proof of such debt, yet they are the first to threaten court actions. These people need to be stopped.

I borrowed money from CashnetUSA in March of 2010 and I have the same people now calling me but I have talked to a guy named Mr. Richards idk his first name, I have already paid them $200 and am expected to pay $400 more in 2 days, They have been calling me with threats also and I was suppose to get served papers, but I made the phone call and set up a payment plan, Friends have told me that they cant do anything to me, and now im scared that I have given the wrong people my money because when i checked my cashnetusa information online a few minutes ago it said i only owed $465 and some change but these people want $600 dollars from me what am i suppose to do???
