I wouldn't fax them from your place of employment or you are opening a door for trouble. There was no fax number available at the BBB site. I don't even know if the address above is valid, illegal lenders are continually changing their location status.

Sorry but I answer so many PM's and posts daily it's hard for me to recall what state you are in, your state laws are what affects you, not theirs.

I'm going to do some research on this and get back with you. You are right, your state law prevails.

There is no license for Authorized Payday in the DE licensee data base, so, either they are lying to you, or they are going by another name, or both, I would say both.
This is what I found on centrinex:

At the BBB I also found the following information, so, you need to file a complaint against them with the BBB so their rating will go down further, and so future perspective customers who use the BBB as a reference will see the complaints:
Name: Centrinex Phone: (800) 351-8820 Address: 9218 Metcalf ave Suite 112
Overland Park, KS 66212 File Open Date: June 2009 Type of Business: Consumer Finance & Loan Companies

I would do more than send a complaint, I would send him a promise that you are filing complaints against them with the FTC, BBB and your attorney general's office, also make sure it is known that there is no license in the DE data base for their company and you do not appreciate being lied to by their call center, tell them you are also contacting Kevin C. Glendening - the KS Deputy Commissioner, Division of Consumer and Mortgage Lending to let them know the details of their unethical lending practices (KS is the location of Centrinex), also contact the Attorney General of KS. Do a little name dropping to these people and I am willing to bet you will get a big fat refund! Also, follow through with your promises. (As you know) :)

Well this battle wont be as easy!!! Authorized Pay Day is playing hard ball and they told me to go ahead and file complaints. So this morning I filed a complaint BBB and the FTC. Now as far as all the attorney general offices what do I say in my complaint letters to them??? I am contacting the attorney generals offices in Utah NEw Jersey and KS. I know my DFI told me that if any internet companies claimed to be licensed here in KY to get them to send proof. Then if they did send me something (which he doubted) to forward it to him and they would file charges for forging government documents.

Who told you they weren't licensed in Utah? I know I checked the licensee data base for Utah and could not find a license for them, however, they may be using a dba name, although I would doubt it.

This is the email they sent me.
Authorized Pay Day, which is located in Utah, is licensed by the State of Utah to make small loans. All such loans are approved and funded in Utah, with repayment to be made in Utah. Authorized Pay Day loan agreement and website contain all disclosures required by Utah and federal law and make it clear that all transactions are governed by Utah law. On the advice of counsel, Authorized Pay Day maintains that the choice of Utah law as controlling in the loan documents would be upheld, as all of the significant contacts in the loan transaction occur in Utah. The loan agreement is legal and enforceable. In responding to your correspondence, Authorized Pay Day notes and reserves all available legal and equitable objections to the points you have raised.
Authorized Pay Day provided this service as a convenience to you. We still consider your loan to be outstanding and are prepared to go to arbitration as provided for in the Loan Agreement between us. As an alternative, if you are experiencing financial hardship, we will be happy to speak to you about payment arrangements through which you can successfully meet your payment obligations. Authorized Pay Day will consider doing so because of our continuing commitment to servicing our customers and not because of a legal obligation to do so.
Should you have any further questions regarding this matter, if you wish to speak about payment arrangements, please contact us at (801) 538-8830.
Sincerely,
Matthew Crowell

Yeah OK, so now they are saying they offer small loans. whatever. I found no license for them in Utah, ask them to send you the license number so you can call the Utah Department of Financial Institutions at 801-538-8830 and verify it.
OK, and I am going to say this again, so any guests out there who care to dispute this, feel free. Your state law prevails, for you, BECAUSE, you are NOT a resident of Utah and have no presence there, therefore, wherever YOU are located are the payday loan laws YOU follow. Now, these Internet payday lenders are aware of this, but still they insist that if they post a disclaimer on their website that their disclaimer trumps the state laws. Well, it just isn't as simple as that, you have NO presence in Utah, and when you signed up for this loan they KNEW this, because obviously you have to give them your address, phone number, etc., etc. So the buck should have STOPPED right then and there, BUT NOOOOOOOOOOOOOOO, they approved a loan for a resident of N.J. anyhow, KNOWING that payday loans are PROHIBITED in your state. So, you tell me, who's fault is it? Who's state law prevails? Where you have presence, or where you have NO presence? Sorry, but sooner or later these Internet payday lenders are going to have to take responsibility for NOT obeying the laws of the land.
Unless Authorized Payday is going by another name, I can tell you right now that they will refuse to give you the information you request regarding their license status in Utah, because they are NOT listed in the Utah payday loan licensee data base. If they refuse to provide you with that information, then obviously they are LIARS.

Do they Attorney Generals office allow for complaints online or it simply a regular mailed letter?

Hi Shazzers
In your message of today, 07:30 PM, in the first paragraph and final paragraph, you speak about checking if they have a Utah license, but based on paragraph #2 I think it is not relevant whether or not they have a Utah license. Because we know they are not licensed in New Jersey, and that is all that matters, right? So why check Utah?

I will call Utah AG office tommorrow and see if they can help me. I figured this one out to be $860.00 on a $200.00 loan. Does anyone know how long it takes once u file with the BBB and FTC to get a response. I cant understand why this company didnt just settle. Isnt it easier for them to just settle then to have people snooping around in their illegal practices? They didnt seem to care that I was filing complaints against them.

Well they dont seem to care that I filed any complaints. In fact they told me if I filed complaints they will no longer speak to me on the phone about the situation. Really can the BBB and FTC and Attorney Generals get companies to issue refunds??? I think I am fighting a losing battle with this one.

I don't know if it's a losing battle, I've never dealt with this lender. I think it's always worth a try, it doesn't mean you will always be successful, but it's better to try and fail then to never try at all.
You on to it

Matt is a good contact at Centrinex. If you have a concern regarding a payday loan speak / e-mail him. He will take care of you. Centrinex is an outsourced call center for multiple payday loan companies, they have the legal expressed authority to represent the companies they service.
hope this helps.
