This firm is suing me, they filed with my local magistrate, I got served last week. It is for an old Capitol One credit card that is closed. I tried negotiating with Capital One last year and they wanted 3 payments of $900, or one payment of $2700 (which was my total balance), neither of which I could pay at the time. We were having severe financial problems so I just let it go. We have since settled with almost all of our creditors. This particular account I have not heard anything on in over a year, so I was a little shocked to get this civil action notice. I called Weltman, etc. and they were not very nice or willing to negotiate. My balance is now a little over $5000, they were willing to settle for $4300 (which is hard to swallow when my balance was $2700). I cannot make that lump sum payemnt right now. They want me to sign some type of judgment paper, said this was in leiu of going to court, and that I can put 10% down and make monthly payments of $250 until the debt is gone. That is something I can manage, but I hate to pay all of the extra fees, and I'm not quite sure what the judgment paper is. I was thinking of telling them that I would like them to send me the paper so I can have my accountant or attorney look it over. I could use any help/advice anyone has. Thank you!


A judgment paper is essentially an out of court settlement agreement. You have every right to see what you're agreeing to before you agree to it. It is a good idea to have your attorney look over the agreement before you sign it. You can have your accountant look it over if you want, but he/she wouldn't be able to give you the legal advice your attorney would.
