I, too, made a HUGE mistake with PDL's

So here is MY story with all of this and would appreciate any feedback that is useful. Which, by the way, I feel this forum is wonderful for folks like me! Well I got involved with payday loans online and live in MI. I apparently neglected a loan back in 2008 and they couldn't collect so I had honestly put it out of my thoughts. I NEVER intended to just not repay it. However, now in 2010 I have a collection agency calling me called Federal IRS Legal Services. They have informed me twice now that by 9 a.m. tomorrow morning (each time they called which were different days) that they will put a summons out for a felony conviction in my state of Michigan (Bay County). I have asked to pay in payments until I could pay the total amount off being that I really did put it out of my mind and don't want to neglect it, and they told me (verbatum), "Why would we commit to a contract with someone like you when you didn't even honor the original contract with the creditor!?" I politely replied, "Then do what you must!" He called me a total of 7 times that day. Today I receive the same call and the same answer when I asked if I could do payments and he since has called me 3 times and left me a very nasty voicemail which in my haste I may have deleted it! The voicemail says to have MY legal counsel contact them IMMEDIATELY as I will be jailed for this by tomorrow. Don't they have to take me to court first? I am willing to pay my loans off but just need to do it without my bank account because I have since closed all accounts and have current payday loans that so far have been very nice about things but say I cannot send it via mail but I can pay them off with a prepaid debit card. Here's the thing: research through this forum states that they are charging me about $15 more per 14 day increments then the state of Michigan allows, and also the state law says no more than $600 can be loaned. My payday loans add up to $975 total so is that $600 cap on a total amount or just at one time? Gosh I hope this all makes sense! I have since learned my lesson, have gone through many lifestyle changes (as many of you have recommended to others) and am slowly pulling myself out but this one about "jailing" me is really scaring me. I know that I owe it and have never denied it but they refuse to take payments so what now?:confused:


Federal IRS Legal Services is NOT a legit collection agency. You can't go to jail for owing a debt, and they CAN'T put "a summons out with a felony conviction". Everything they said to you is ALL BS! Just the way they worded it is ridiculous.

You need to file a complaint against them with the FTC and your attorney general's office. You can do this online, very easily.

Never agree to owing a debt or making payments on a debt, to a voice over the phone, you are entitled to documentation via the mail. EVERY collection agency is required to send the debtor a letter of collection via the mail within 5 days of their first initial contact with you, that is a federal law (FDCPA).
