Received Summons and settling at same time

Hi,

I got a Summons from Chase about 2 weeks ago. Just yesterday I negotiated with a Chase rep to settle my account at 50%. He told me that once I make the payment, the lawsuit will stop and the Summons will automatically be withdrawn, without me having to do anything.

Is this true? Or should I answer the Summons?

Please help.....thanks.


No, as you have received the summons you will have to answer to that, even if you reach an out of court settlement with the creditor. Can you tell whether or not you got the settlement agreement in writing? If you have not get that in writing immediately, and answer to the summons. Else the creditor can sneak in a default judgment against you.

Thanks SC. I haven't got it in writing. Chase said they will send it to me after I make the 1st payment (out of 2 installments). Another question, the summons was filed on April 13, 2010, but I just got it in the mail about 10 days ago.

Do I have 30 days from the day I got it in the mail? Is this what it means by being "served"? Or is it 30 days from the filing date in which case I'm screwed....

Generally the date is mentioned along with the summons. However, the 30 days starts from the date when you were served with the summons. Another thing is, you shouldn't make any kind of payments without getting the agreement in writing. You will have no proof that Chase agrees to settle your debt.
