With my summons, I received an affidavit from some Elizabeth Kendall.

She claims to be a legal specialist and has access to records for Midland Credt Management, Inc.

On the summons the Plaintiff is Midland Funding LLC.

Are midland credit management and midland funding llc the same company? on my credit report it lists midland credit manangement.

object to the affidavit as hearsay then, the affaidavit must be from a credible person from the original creditor.not an employee of the plaintiff.if you don't motion to strike the affidavit as hearsay, the judge will allow it.

yes I already sent the motion to strike the affidavait.

I just reread this summons and it says i have to answer to the complaint in room 602 as required by Par. 3(c) in the notice of defendant below.

on the back of the summons it says " if you are sued for $10,000 or less you need not file an answer unless ordered to do so by the court.

so would I have to file an answer b/c it says I should on the front of the summons.. How do I file an answer?

thanks so much
