An interesting article you may want to read, posted at the BBB site. One of the things that will probably happen when you pursue a refund from these people is this; they will tell you that they are not required to follow the state laws of the U.S. because they follow the tribal laws. Just keep in mind that you do NOT follow their tribal laws either. I think the only ammunition you may have in pursuing a refund from these people is by smattering their name all over the Internet in an attempt to prevent other people from obtaining loans from them, and I would make sure you make them aware of the consequences. See the article below:

A BBB investigation of this company determined that Paycheck Today is located at the same address of the Modoc Nation Indian Tribal Office. During its investigation, BBB employees visited the location as well as sent a certified letter to the Chief of the Tribe asking for further information regarding this company. The investigation revealed four other loan companies (Cash Advance Network, MTE Financial Services, Instant Cash USA, and 500 FastCash) are located at a smoke shop/casino operated by the Modoc Nation Indian Tribe. An employee of the Modoc Nation Indian Tribe was reluctant to speak with BBB staff but confirmed Paycheck Today does operate out of the Modoc Nation Indian Tribal Office. However, he did not provide further information. BBB has not received a response from the Chief concerning this matter. At the present time, BBB does not know if these companies are operated by the Tribe, by employees or other people using the Tribe's addresses, or is a joint venture between the Tribe and a for-profit company.
The complaints against this company, as well as the other loan companies that share the same address as the casino/smoke shop operated by the Modoc Indian Tribe, generally allege the inability to pay off the requested loan, charges to the consumer's checking or credit card account despite never receiving the requested loan, or continued unauthorized charges to the consumer's credit card or checking account once the loan has been paid off.
BBB has determined that this company is not licensed in the state of Oklahoma to provide loans to consumers and does not appear to be licensed in any of the states from which consumers have filed complaints with BBB. However, if the Modoc Indian Tribe actually operates this business, it may not be subject to state laws regulating this industry.
I also need time to think about a plan of action on how to pursue this with full force, I may have some ideas but I have to put my thinking cap on and do some more research. I have to work today (second shift), so it probably won't be until tomorrow, late afternoon, I work day shift tomorrow. Meanwhile, maybe other people will come up with some ideas on how to light a fire under this tribes butt. lol

Hi again, I have been doing some thinking about this, and based on the information I obtained from the BBB site, my thoughts are that what is needed is to send a crystal clear message to these lenders to let them know you are fully aware of their unethical practices. Maybe even include a copy of the report from the BBB about their location ( a smoke shop lol ).
Something else I have been kicking around is contacting the web server, where they rent their web space for their ads. I found out some information for Paycheck Today. Their web service has a terms of service:
http://www.webtrends.com/AboutWebtrends/TermsOfUse.aspx
I also obtained information about who their host it:
Name: James McDermott
Title: VP and General Counsel
Address: Webtrends Inc.
851 SW 6th Avenue, Suite 600
Portland, OR 97206
E-Mail: contracts@webtrends.com
Phone: 503-294-7052
Fax: 503-294-7130
What are your thoughts on this?
Since I got off of work earlier I haven't had much time to devote to this but I wanted to share some of my thoughts so far. I am too tired to think straight right now so I will continue to kick this around and get back with you sometime tomorrow before I go to work again (I work second shift tomorrow).

Thanks Shazzers, I think so far what you said is some great infromation. Its amazing to me that these businesses can really get away with this. I would think with all the people on this forum we really could cause some uproar!

That's why I always tell people to file complaints, the more the complaints received by the FTC, BBB and AG's, the better the chances of laws changing and investigations be made. Keep us posted.
