I call all my debt collector with same story every hour . Lol...I hardly here from them as a result.
you might be sounding deperate!
they might not give you as good a settlement if they know how anxious you are--just a thought..anyone care to share their thoughts?
If it is a third party collection agency, I would not call them
If it is a third party collection agency, I would not call them at all but make them commicate strictly by mail! It is your right under the FDCPA! Why go to bed with that burned into your head! You need peace of mind and ear!

Frogpatch.....there is no such thing as a partial cease and desist...you cant make them communicate thru the mail only. It is all or nothing.

Lol. I do it to get a kick out of it. They've already know what I can offer and that is it. Take or leave it. It's so funny when you stumped their game. They act like little kid who lost his candy. Lol.
I know how collection agency works. I'm in 150k debt in CC. Probably the highest debt holder in this forum.
I dealt with majority of big lenders and truly understand how they worked.
I also prevent accounts from going to third party collector or charge off, unless of course I missed a card . Possible when you own 25 credit card.
Anyhow, most of cc are with original creditor who have assign accounts to collection agency to collect on behalf terms.

Huh??? you really dont understand the game you are playing. If you are with a collection agency, you ARE charged off...you ARE working with a third party agency.
Eventually it will all come back and bite you in the ass. The big lenders do actively sue.
And no, you dont get the crown for the highest debt load....there are people here with double your amount.

As far as loan is concerned it is not a crown of big achievement rather the person is with big responsibility.I will be having much respect to those guys who are debtfree and earning enough for their sustenance rather than those who need to earn enormous in order to pay their CC bills.
My priority is prevent law suit. Simple as that. I'm not saying
My priority is prevent law suit. Simple as that. I'm not saying I will not settle with the collection agency. However, I do know that once the account is with a collection agency they tend to hold the account for about a month or so before its passed backed to original creditor or possible law suit.

Soaplady, I went back and read through the FDCPA and you are correct! It is all or nothing! For years the advice given here was USPS only and it was even in a sample letter that was going around! I have actually put it in my own letters to CAs a while back and it worked! This time I stand corrected! I will post this error for the others to see!

I second that. Just because the debt is with a collection agency does not mean original creditor no longer has the right. For example, Amex is known to hire Nationwide or NCO financial to collect debt on behalf of them. None of these financial companies actually own the debt. Their not consider junk debt collector.
Anytime amex will retrieve account from collection agency any time if they feel the collection efforts are dull.
Does this make sense ?
I know what I'm doing . :)

Amex is a good example! I have a past due with them that has gone back and forth a few times! The collectors are working as agents for them in return for a fee or commision! If they are not successful or partially suucessful they return the debt to Amex who can farm it out to another or keep it for whatever reason!
My point is that the debtor does NOT have the right to demand.
My point is that the debtor does NOT have the right to demand. It all depends on the contract between the agency and the creditor. The agency I worked for was a top agency for several of the big creditors. Our contract was iron clad....as long as there were no FDCPA violations, the creditor could not recall the account for 90-180 days. Debtors would bitch and send their payments to the creditor and the creditor would turn around and forward it to us.
