Ok, so I just talked to Chase and made an offer. They said that it was charged off already and it's going out today to either a collection agency or a lawyer. I offered to pay them 1000 dollars in Sep, Oct and Novemeber and be done with it. Again they said they could only settle for a one time lump sum and I would have to talk with whoever ends up getting my debt. My question is, did I screw up and wait to long?? Unfortunetly I just found this forum 2 days ago and that's also when my debt was charge off. I missed it by 2-3 days...lol. Will a lawyer of collection company be better or worse to deal with? Are they more likely to sue me over the debt? Can Chase still sue me? If Chase hasn't sued me already and instead sold my debt is that a good sign that I'm not a good candidate for litigation??

Well quite frankly it doesn't matter if it's better or worse that you charged off. The reality is that it did charge off sooo - since they are telling you they won't settle because its going somewhere else, wait until you are contacted by the someone else and offer a settlement a little below what you can do so they can bargain it up and then accept it where you are able to do it.
You will just need to explain your hardship and if they feel they can not get any more from you by suing they will probably take it. If they feel you defaulted just because you didn't want to pay it, then it's a little more difficult.
