Can I know if you mean that you got the summons after the judgment was entered? If it is so, you can file a motion to vacate the judgment. Go to the court, and request the court clerk to provide you a form to file the motion to vacate the judgment.

You can also get help from an attorney.

Hi Brenda,

You can file a motion to vacate the judgment as you did not receive the summons before the judgment was entered. According to Fair Debt Collections Practices Act the creditor or the collection agnecy is required to serve you judgment notice. If possible you need to show proof that you received the summons after the judgment was entered.

After the judgment gets vacated, dispute this with the credit bureaus. Along with the dispute letter attach proof of the vacated judgment. You will have to change the wordings of the letter as per your circumstances.

Thanks
