LVNV trying to collect on debt i do not recognize and from their reporting on my credit report i believe is time barred even if i do owe it. they already tried to sue me and case dismissed w/o prejudice b4 going to trial. now its been passed along to capital managment services to collect on their behalf (at least this time i am being notified b4 being sued). Do I have to send DV to Capital Management only or to LVNV as well? Problem with sending to LVNV is i cannot find an address to send certified that they will actually sign for. Thanks for any input on the matter.

You need to send a copy of the dismissal to Capital along with a letter for them to cease and desist contacting you and to validate the debt! You also need to send a letter to LVNV demanding that they validate the debt and send a copy of the dismissal! Make that a scathing yet professional letter! Their address should be found by doing a search above in the search box! They are one of the worst agencies in the country! Also contact the credit reporting agencies and challenge that report! If you can get an attorney do it and go after LVNV for violations of the FCRA and whatever else the attorney can determine!
