I have a question, i missed the date for court on a past due credit card from 2005. So they made a judgement that I paid. When I tried to contact the attorneys and place where i recieved the summons they number is no longer in service. I also tried to call a 800 number that was on there as well. That number has been disconnected as well. What do I do now? How do I pay it if the attorneys at law that sent the summons is disconnected and when I called citibank they have no record? thanks


That is a very good question. Typically when you get a judgment against you you don't pay the attorneys you pay the plaintiff and they do have to tell you where to make your payments too.
Was Citibank the plaintiff or was it a collection agency that was suing you? If it's a collection agency and Citibank sold the right to collect then that is why Citibank doesn't have any records.
My advice in this situation would be to talk to a lawyer in your state who specializes in collections law. Most lawyers give a free initial consultation before asking you to pay them, and there is also my favorite free legal advice website www.lawguru.com.

The plaintiff was a collection agency Citibank sold it too then. I find it very strange that they would take the trouble to sue you, get a lien on your house, then disappear or at least not give you a way to get in touch with them. My gut feeling is that something fishy is going on and you definitely need some more specific legal advice than I can give you.

This entire situation stinks. LVNV are a bunch of crooks. It is a shame you missed that date and they obtained a defualt judgment. If the amount is over $1500 or so I would advise obtaining an attorney and attempting to over turn the judgment if possible. I doubt they can validate the debt and the debt is also out of the SOL probably but none of that matters unless you can get out of the judgment. If it is under $1500 you can try to do these things on your own to save the lawyer fees or you can try to settle with LVNV for less than the $1500.

What you can also do is if you succeed in vacating judgment due to their strange behavior is ask for your court costs and attorney fees as damages. Vacating judgments and/or appeals are complicated, enough that there are lawyers who specialize in civil appeals. At the very least, I recommend consulting a lawyer about your possibilities. Most attorneys give free initial consultations and many lawyers are adjusting their fees so that you only pay for the services you actually use.
