I was just informed today by my brother that they had called.I called them wondering what check i had bounced. I wasnt aware of any.And i am sure i would be. Appearently in Dec 08 i took out a PDL. Which i did not. These peopel stated they have my name DOB and SS #. I asked what payday loan company and they couldnt answer that. I told them i wanted further information on this cause i was calling my attorney. They threatened me with jail, etc same as above. He then asked if i have checked my credit report and i said because of a divorce i just filed for bankruptcy and went to court in April. He said at first it would be on there untill i mentioned bankrubtcy and then he said it wouldnt go on my credit. Well truthfully guy what is it. I told him everything went on that claim. THe funny thing is i never took this out. I told him i had to file a fraud case against an ex boyfriend for him opening utilitys in my name. He said welll it doesnt matter its in your name the judge will see it that way along with anyone else. He said pay it and be done with it. I told him hell no its not my dept. I asked for paperwork and my signiture be sent to me as proof and he said he couldnt send it. Iasked for and address and no address. He said well then go to court lose and pay 600% interest. I said what. R u out of your mind that is by far illegal and if there are no supporting documents then go to hell. He argued and called me everything but a white female. He said call my attorney tomm. I gave him my attorneys name and where hes at. I told him to contact him. He still went on to say if this is fraud there is nothing that can be done. Im responsible and i will go to jail and have felonys on my record. I dont know much about the law but this is illegal.
You can't go to jail for owing a debt! This sounds like a scam,
You can't go to jail for owing a debt! This sounds like a scam, you REALLY need to file a complaint against them (with their phone number at least) with your Attorney General's office, and the BBB. Please provide as much information about this company as you possibly can. If you are 100% sure you never obtained a payday loan from the Internet or otherwise, yet they have your SS#, this may be a case of identity theft, therefore you need to take the steps necessary to protect yourself.
