Hello all,

I was brought to this site by doing a search for Asset Acceptance, but all of the threads here don't seem to fresh about this company. I have been in contact with them about my alleged debt, but not really sure if I should believe that my account that was last paid in 11/06. This card was only my emergency gas card in college and I haven't heard anything until the last month. Now they are telling me that they don't have any history on my account except the amount they paid for it, the interest on the account, and the dates of last payment and date sold to them. I asked them to send me the payment history on the account and they replied with we don't have that information and are not legally bound to provide that information. Cap One says that they don't have account information after it is sold. What would be my next steps in making them prove this debt is true. I was sure that this card was closed and paid off after I was out of college since it was a high APR.

First, you MUST send them a Debt Validation letter(search this site for a template). Next, they ARE legally bound by federal law to provide you with the account history, the signed by you credit card agreement and more, DO NOT believe them if they tell you otherwise, they will lie to scare you. Asset is a bottom feeding collector, odds are they have NOTHING to validate the debt. You first must send a DV letter by CMRRR, thats the first step to take. Do not speak to them on the phone, in your letter state that all correspondence must be in writing by USPS, that why you have a written record of everything. ALso, what state are you in, if last payment was 11/06 depending on where you live it may be SOL which means they cant sue you for it, just harrass you for money that you legally are not obligated to pay. DV them first, cmrrr, most important thing to do is that!! Once that is done we can go from there
