Can anyone tell me about wage garnishments in Wisconsin. My employer received one from a payday loan company that I defaulted on and it did not go thru the courts and doesn't look real to me. Can someone tell me the process for garnishing someones wages. I am trying to work with these companies myself but it's not easy.

Before a lender or creditor or collection agency (CA) can garnish a debtor's wages, the creditor/lender or CA will have to win a lawsuit against the debtor. If you are sure that there has not been any lawsuit against you, you can talk to your employer about this, and file complaint with the Federal Trade Commission. Also complain about this to your State Attorney General. You can even sue them for the violation.

Moreover even if there was a court case, you are supposed to be served with a notice regarding the judgment. If you did not receive any paperworks regarding the lawsuit, you can file a motion to vacate this judgment.

In Wisconsin, generally up to 20% of ones wages can be garnished. However, this also depends on the outstanding debt amount. You can check out garnishment laws of your state from http://wilawlibrary.gov/topics/laborlaw/garnish.php .
