My ex-spouse declared bankruptcy last year with several thousand dollars due in unpaid child support. The Child Support agency told me they could no longer collect interest on the debt due to the bankruptcy declaration, however the amount due each month would still accrue. At this time, he is working, although eluding attempts at collection, and additionally purchased a lake front home last month. Is there a possibility that his bankruptcy was discharged? Is there a way to find out and if so, is there a way I can begin interest accrual again?


Bankruptcy filing does not discharge one from child support obligations. The automatic stay can have no effect on child support. The person filing bankruptcy is still liable to pay the child support. Thus, you can go to court about this. You should also consult a good attorney regarding this.

You can visit the United States Bankruptcy Court Federal Record Retrieval Service's website. From there you can get the details, and also can order the bankruptcy discharge papers.
