Can I sue the collector's firm for every they violated the FDCPA in the summons and Complaint? Or does the Summons and Complaint count as one violation? Basically, the firm used my social security number and account number in the Complaint and the attachments. So is it $1,000 per every time my account number, etc. comes up in the Complaint or is it just $1,000 for the entire Complaint?


It is a violation of CA Court Rule 1.20 to list a person's full account number or SS# in a public court document, such as a Complaint. A case was filed against me by a collection agency where they listed my full account and social numbers. I think this is also a violation of the FDCPA. If it is, I want to know if I can get the $1,000 statutory damages for everytime the violation occurs in a court document or if I can only get one violation per document. For example, my account number appears 6 times in the Complaint and in the attached documents to the Complaint. Can I counter sue for $1,000 or $6,000?
