You must send a Debt Validation letter to each collection agency listed. Search this site for the templates and format it to your situation. They must show ownership of the account, original signed by you credit card app, payment history and bill of sale from OC to them. Read this site on what debt validation is so you know what they HAVE to by federal law supply to you-if they tell you they dont have to, know that they are lying to you, its a federal law that you have on your side that they MUST validate according to the FCDPA. Have you ever been contacted by any of the collectors? Send the DV letter, if they do not properly validate they must remove from your credit report. Start there before anything else, no matter what NEVER give them any banking info without it being validated and everything MUST be in writing before you pay anything!

Thanks for the heads up on this Ive been searching High and Low on these boards seriously got a headache but its worth it...I have not been contacted at all by any of these collectors...I think alot of that has to do with me always moving since Im in the military I will look for the DV letter and go from there so I would send a DV letter to all the companies and then wait????? Is that correct and how long do I wait Im so lost on all of this

Send it to each account listed on your report. There is no set time for them to respond to your validation request, unless you live in Texas-then they have 30 days, also at the same time file a dispute with the credit bureaus as not yours. Give it at least a month or two and check your reports and recheck your credit reports and see what they are reporting then. You may hear back from them or you may never hear back and they disappear off your reports. Just keep checking your reports and make sure when and if you get validation from any collector it has what is required by law, take nothing less and dont let them tell you anything different. Search this site and ftc.gov for what they are required to prove in validating a collection account. Stay calm and do not let them bully you. Also, in your DV letter include a point that all correspondence is in writing only, that way you have a paper trail, send it by CMRRR-certified-return receipt. Keep a paper trail.

Honestly, being military thats a good question. I know if you live in Texas they have to respond within 30 days, that should still be the rule as that is your permanent place of residence. I would send the DV's to them and list your address as your Texas addy, that way they know right off the bat you are a Texas resident. Texas has the toughest laws in the country for debt collectors. I would send the Dvs using the Texas address, if you havent heard back within 30 days check your credit reports and make sure they are removed. Or if you want pm a couple of the moderators here-paulmergel, skydivr, soaplady, these people are great and really seem to know what they are doing. They have taught me so much about the laws for this stuff. But, i would send it using the Texas addy and then wait to see if you ever hear back, quite possibly never will. I will watch this thread to see if you write back, my name is Lisa by the way

Ok thanks for the help Lisa very nice of you my name is Carlos by the way... Ok so basicly if I got this right and waiting for someone wether it be you or a other member from this forum to chim in and tell me if Im doing this correct

So I went on the boards here and found the sample debit validation letters Im actually going to use one of those and then I basicly wait...I have 6 collections on my report is that correct on how Im doing this I changed the wording a little in the debt validation letters since Im not a good writer at all and inregardes to the last payment well no payments where made on any of these so what year do I go by the date the account was open or the date the account went into collection????? Im a lost for words on alot of this any help is wonderful if you could give me step by steps on what to do since I actually work better in given directions sorry but after getting hit by a IED my life has changed and Im slow at things

I also was told since Im not physical living in TEXAS thou TEXAS is listed as my home of record I can not use the address I had anymore since new people moved in thou I had a POST OFFICE BOX that mail got sent tooo I can still use that I was told and it will still be FORWARD for a YEAR from the time I put in a CHANGE of address so Im curious what should I do on this NOW????? Since I spoke to my Military Command on this of course I did not go into detail on why I inquiry and they said no good question that i ask so basicly TEXAS is listed as my HOME of record and will stay that way since I do not get TAXES taken out and basicly the only address I have in TEXAS right now is a POST OFFICE BOX for about 7 more months and then I can not use that anymore so Im curious what to do in this suitation??????? Or I could easily use my sisters address who in TEXAS????? Thank you Ill wait for a reply since I do not know what address to use and my sister would not collection people after here??????
