Has anyone seen the artcicle on AOL dated July 15, 2010, about people being taken to jail for missing court hearings resulting in a default judgment? This is very scary to me. Does anyone know anything about this? I thought debtors prisons were abolished long ago?? If anyone has more information on this, I would appreciate hearing more.

Typically, this occurs when you do not obey a court order to attend an examination (meant to be a legal assessment of your ability to pay). If you fail to show you are charged with a failure to appear, that can result in a bench warrant being issued. You are being jailed for the debt, but rather can be arrested for not attending a court ordered hearing. This same kind of thing can happen any time you ignore a court order to attend a hearing.. also this is usually done along very specific state by state rules.. so no one should panic.. this is not new the potential has always been there.. but potential does not mean likely
