HI, I am being sued by Asset Acceptance LLC. I live in Michigan, the original debt was the end of 2004/beginning of 2005. I am not sure of the date. I was contacted several years ago and verbally asked for verification of the debt. I never received it. I received a summons the end of May and sent a letter to the court stating that I asked for debt validation and never recieved it. The court has now sent back a Pre-Trial statement I need to answer with a date in August. I have contacted AA LLC to change the date (as I will be out of town) and left a message with their attorney. I called again and the rep would not transfer me. I also sent a certified letter for debt validation before contacting AA and the court. I called AA LLC again today to change the date and left another message. The woman I spoke with said their marketing department was working on the debt validation and asked if I would like to settle or make payment arrangements. My answer was no and asked if I could be transferrred. Any advice??

If this debt is out of SOL for Michigan.. Go to court***SHOW UP*** and bring something with the date of last payment..charge off date.... and SLAM Asset Acceptance LLC! EASY job....judge will toss out SOL expired credit accounts....If you NO show===they win

Hi unregistered; You need to speak to a Legal Clinic or Attorney now. Even though it may be past Statute of Limitations, you didn't respond to the Complaint.

Paul Mergel is also right, the Court can help you with a Motion for Continuance, to change the date. The Plaintiff will not be any help to you on anything. Don't even bother to contact them anymore. And they are lying - they aren't working on the Debt Validation, other than getting ready for Court, to slap a judment on you.

It might be better to Answer the Complaint late; than not at all. Again you need to speak to an Attorney about that. Legal Advice is something, a Court clerk cannot help you with. They can help you and answer procedural questions only such as a Motion for Continuance.

I also have a M 4 Continuance I've done in the past. I am not an Attorney, I have fought 2 of my own lawsuits against us on my own with out an Attorney. I cannot legally advise, but I can advise what I would do, if it were me in a given situation, such as above.

My thoughts are Better Late than Never, and if SOL is indeed up, then you may have a good Affirmative Defense to start with, that I personally would try for, if it were me.

I don't like CA's and I don't like their Attorneys. I don't like CC banks or their Attorneys, so I help people, by sharing what I have, in my informational stockpile. I have helped people with lawsuits with favorable results. Time unfortunately isn't on your side - but I wouldn't give up totally!

Unregistered; I need to continue by stating I am knowledged in Consumer Protection Laws and as well as with my own personal lawsuits without an Attorney, I have helped others, have favorable results also.

I can't guarantee a favorable outcome for you - but it's worth a fight! And yes NVASSARX is also right, You have to show up for Court, or you will lose for sure, again by default judgment.
