Well They didnt give me the paperwork I wanted in Aug. THen they call in Nov and threaten me. I called back and let them know that I am NOT one to be played with that what they were doing was ILLEGAL and unethical. I dont care what they do, but they cant file NO criminal case first of all against my dh because defualt is not criminal. And they cant file in NEW YORK, I reside in Ohio and no crime was commited in NEW YORK. They continued to tell me they are a proscuting atty.. YEAH give me a break. My local county prosecutor would be calling me, not some yoohoo in new york.
I wanted paperwork with the acct name, how much was already paid, etc. They didnt furnish it. So the guy calls back, you agreed to pay X amount. well I told them listen, you didnt send me my request and until you do, you dont get a dime. He awnted to fax it. sorry buckeroo, I have no fax. He told me to take my 5 yr old out at 530 int he evening with 2 inches of snow on the ground and to FIND one. EXCUSE ME? Then they get nasty, you blah blah, you need to take care of this. This is giong on his credit BLAH BLAH! Puhlease, spare me your stupidness!
So to make a long story short, I get a call from a women, it is now coming up private. And she is from that company. And do you know that they DONT use the "criminal" charges crap on my voice mail this time. HA!! Dont mess with me! LOL I still dont have the paperwork that they promised. And they still wont get paid. PERIOD!!
Oh and better yet... they "threatened" to file a lawsuit. Fine if you are going to threaten me, you best follow thru. Because I know that if you DONT, that is ILLEGAL too!
They arent going to send someone from NY to file a small claims lawsuit in my small hometown, to make 2 or 3 or even more trips back and forth to get their money. I am so not worried about it. They probably only have the Burgess guy as the ONLY atty there! If he is even a real atty!

Do you have the exact name of the "law office", or any other contact on them. Anything you can share will greatly help the community, as when people do google searches, it shares information posted from our community, and might end up helping others dealing with them.

Sully, next time, if you are talking to any collection agency that is not acting according to the norms of the fdcpa, get that call recorded for legal actions. As you are residing in Ohio, it is entirely legal to record the call secretly as per the statutes.
After you have recorded the call, you will have a proof of what was being said and take actions accordingly. It is also preferred to do communications in writing with such agencies. After you have sent a cease and desist letter and prefer to communicate only by mail, the company will be legally restricted from calling you further.
You have stated some important facts towards your favor and it makes your case legally stronger. If you don't have any proof of it, things might take a turn if the matter reaches the court.
