Creditors calling family?

We are late on our mortgage. They are now calling our family. Can they legally do this? Is there anything we can do to stop them?


My husband just talked to them last week. The person got really nasty with him and he hung up on them (after warning her he would if she didn't stop). My husband is easy going so she really pushed him for him to hang up. Anyway, maybe that is why they are being more aggressive? We are only 3 payments behind our last payment was in July. He is going to call them today.

They told us if we made a payment then they would defer the 2 late payments. So we made the payment and then they said they changed the policy and we have to give them financial info and bank info to make an electronic payment then they would defer.....ummm no so now they are on us every day.

You can snag the stuff at that shack that sells radios.
Very cheap and well worth the change.:D

BTW, what mortgage company is it?

I digress with my personal story.....
Just a couple of years ago, I refinanced my house.
Old mortgage company said that I owed 21k in accrued back interest.
And that it would takes months to resolve this matter.
The guy was toilet bowl matter.

I exploded, found the company directory and with a little help from the net, got the info, called a couple of the big dogs at home. Told them the truth regarding their customer service, sent them each a registered letter at work.

The 21k issue was resolve in less than a week.:cool:
They fixed the misposting of my payments and the final amount was zero.

The dirty roaches are playing a psy-ops game with you.
Pressure/anger they hope results in payments.
It's a shame that's the best they have and can't show some compassion!

Just venting.

Hi Jill,

I think you've done the right thing by contacting the CA yourself since they're harassing your family members. As per the FDCPA laws, the collection agency can call your family members and inquire about your address.

But, the part where they've violated the law is, they've used abusive words against you when you called. The next time you call, make sure you record the call. Any abusive words can allow you to sue them.

Another thing you need to do, whatever they say take everything in writing. It'll help you if you file case against them.
