Paydayone in Louisiana
Date: Thu, 07/22/2010 - 20:04
I have a question - I have had this loan since 2008. Obviously it has gone up and down. When I looked at the laws in Louisiana it says no more than 350 with a 5 servicing fee and 45 fee. However, their site says they can loan from 100 to 1000 legally in Louisiana.
I was paying them until my loan due date fell on a Sunday and when I tried to pay the interest only on friday evening I was told it was too late to change it. This caused my checking account to overdraw. They are now claiming that I owe them 10.00 a day in interest/late fees. They've tried again to debit my checking account for the original amount and an additional 100 fees.
THey called tonight and I explained to the woman on the phone that I do not have the money they want and that their lending practices are illegal in Louisiana. She stated that they follow the law. I stated very calmly once again that they are only allowed to lend 350 with 50 fees. She asked me to hold on. She left me on hold for what seemed like an eternity and I hung up.
So I just went on their site and copy and pasted. Since 2008 I have borrowed 3695 and paid them back 7379.20.
We have opened a checking account at a different bank so that I can hopefully get my bank to close my checking account. Our bank actually informed me a few weeks ago that they may investigate our account due to the payday loans.
I have 4 online - all of which we were paying regularly up until this month - we orginally had 7 online, but we've managed to pay off 3. We have 6 storefront loans.
I am in hell - I don't exactly understand the laws of our state and would greatly appreciate any help

I think payday loans are fine for occasional use IF you understand what you are doing and don't take out more money then you need.

I absolutely agree, but when you find yourself in a mess - in order to pay the incredible amount of interest - I had to take out a loan and then I'm in even more trouble. My son got sick - no insurance. In order to get the prescriptions and copayments to be seen in the hospital - a loan.
It is really easy to sit back and judge
