I am in contact via email with these people...and they keep spewing Delaware law superceeds Nebraska law. Anyone have a good comeback? I fully intend to pay the intitial amount borrowed, but I don't think I should have to pay double the legal fees allowed in my state. Any help would be appreciated.

Here's the response I just received from them:


East Side Lenders, which is located in Delaware, is licensed by the State of Delaware to make small loans. All such loans are approved and funded in Delaware, with repayment to be made in Delaware. The East Side Lenders loan agreement and website contain all disclosures required by Delaware and federal law and make it clear that all transactions are governed by Delaware law. On the advice of counsel, East Side Lenders maintains that the choice of Delaware law as controlling in the loan documents would be upheld, as all of the significant contacts in the loan transaction occur in Delaware. The loan agreement is legal and enforceable. In responding to your correspondence, East Side Lenders notes and reserves all available legal and equitable objections to the points you have raised.
East Side Lenders provided this service as a convenience to you. We still consider your loan to be outstanding and are prepared to go to arbitration as provided for in the Loan Agreement between us. As an alternative, if you are experiencing financial hardship, we will be happy to speak to you about payment arrangements through which you can successfully meet your payment obligations. East Side Lenders will consider doing so because of our continuing commitment to servicing our customers and not because of a legal obligation to do so. Seriously, are these people for real? Here is my latest response from them.

Thanks for the reply. You came into our store in Delaware when you applied for the loan on line. The money came from Delaware & is being payed back to Delaware. You will have to pay via credit/debit card or Money Gram. Everything we do is electronic. Which payment option will you be using?

WOW! That's a new one on me, now they are claiming you went into their store! You'll just need to rebut that for your records! What a bunch of liars!

I've dealt with them in the past. They will keep sending you the same e-mail, until they tire and then turn it over to a collection agency like they did with mine.

Did you fax them signed paperwork? If not, then they only have your "electronic" signature and can't prove you went to Delaware. Indeed, like you'd travel that distance!

They won't listen to you; won't accept any payment except electronic(perhaps you can try prepaid credit card). That's how I got turned over to collection. Wouldn't give them my checking account number.

Once they turn it over to collections then you can request validation, proof of assignment and their license/bond number.

Don't lose too much sleep over Eastside. They are illegal. Stand your ground.
