Midland Funding Suit for Credit Card Debt

Hi, I am being sued for an old credit card debt by Midland Funding. I was served at my home. I filed a copy of the debit validation letter I sent to Midland within the 20 days. I received back from the attorney representing Midland a computer generated copy of a Citi Bank credit card statement with my name and old address at the top with the last activity on the statement dated 4/07 and showed a payment was made to the account 11/09. It does not indicate who made the payment. A telephonic statis conference was scheduled this afternoon between the judge, the attorney representing Midland and myself pro se. I called the judges office this morning to make sure they had my phone number. I did not receive the conference call. I assume the judge ran behind today. I plan to call the judges office in the morning to check on it. Will the judge reschedule the call between the attorney and I? I plan to dispute and request a pre-trial conference be scheduled based on there being no relationship between Midland and myself and they are not the original creditor. I don't know what I will need to file next. Do I need to file with the court my affirmative defenses now? In what format? Any help would be greatly appreciated. I don't know what to do next. Thank you!


I would assume if the Judge ran behind his secretary would have called you. What I think happened is the Judge never received a call from the attorney so he dismissed the case. I'm not a lawyer but a couple of years ago I was being sued in Florida (had since moved to another state) and received a summons at a relative's house for a conference call with the Judge (the same as you) before my appointed telephone conference I called the Judge and explained I moved out of state he told me if the attorney does not call he will dismiss the case. Midland probably could not prove a thing they were just trying to scare you. Have no contact with them unless it is certified mail. I've had dealing with them and they are nothing but a junk debt collection agency. Any papers they say they have on you are probably falsified.
