They're full of crap, it's your right to stop preauthorized transfers if you so desire, per the EFTA. You can't be arrested for owing a debt.

Whose name is the loan in, yours or your husbands? I would think if you were able to take a loan out in your husbands name without them talking with him just proves how illegal they actually are. You can revoke your ACH at any time they are just trying to scare you!

You can tell them not to call, but that doesn't mean they will listen to you. You are dealing with an illegal lender, they have no regard for the law or they would have never issued you a loan, they will harass you to death but the thing to remember here is, you are a victim and can not control incoming calls from scammers, you need to explain this to your employer BEFORE the calls start.

Cross that bridge when you come to it!

I just want to chime in because I just got a different DE payday lender to drop everything and say the debt was now closed & paid in full after I confirmed they were not licensed in my state & followed the "Dealing w/unlicensed lenders" advise.
Of course PDL insisted DE laws apply as the loan originated there, not in my state, but I kept correcting them. Luckily I had an email address, which helped w/instant communication.
Anyway - One thing that I think may have helped is that I pointed out to them how their website has a list of states they do not lend to. I said I assume they avoid those state due to strict PDL laws and asked them why do they abide by those laws and not my state's laws, which I thought was going to be a tough one for them to fudge an answer to. Didn't get an answer to that question, but I got the answer I want - no more ACH debits - bill paid in full.
Anyway - if you want to read my post here's a link. I had success, so it may be of help to you.

Please file a complaint with the IL Division of Financial Institutions (aka Dept of Professional and Financial Regulation) to get NWC to stop lending to IL residents (they're not able to lend to IL legally). here's the online complaint form (the more complaints, the more likely IL will be added to NWC's "you come to DE to get a loan unless you live in one of these states that make it illegal to magically teleport to DE to get a loan).

They're bad news, I suggest staying away from all of these companies. I would rather suck up my pride and borrow the cash from a friend or family member than resort to dealing with these people. It's not worth the headache.

I got a notice from them as well and they are saying that they don't have to be licensed in my state because they are backed by Federal Law, but yet not by a bank? what does this mean and how should I handle this?
Thanks

I have been dealing with these creeps as well.
I sent them the letter for being non-licensed in my state and they never replied until today. Got at call at work (violation of Federal law) and the guy, a Mr. Paul Miller, stated that state law does not apply since they are based out of Costa Rica (thought they were Delaware). I told him that since he was in violation of Federal and State law that he needed to take the matter up with my state attorney general and get back to me in writing if he was indeed legal to operate in my state.
Well the dude threatened to call my family, friends, work etc. cussing me out all the way. I hung up on him and he promptly called back. The receptionist told him I was busy, during which time the head of the HR dept picked up the wrong line by mistake and he cussed her out. She knows the law pretty well and knew this guy was up to no good so all it did was make her want to reach through the phone and draw blood.
Not sure if he will call back again, but if he does he will get the same response. This outfit is very illegal and bad news. Stay away or get out of dealing with them as fast as you can. They have no regard for the law whatsoever.
