asset acceptance llc garnishing my wages

i just recieved a garnishment notice from my payroll co. informing me that i have been sued, with a default judgement against me for $9809.21 plus intrest, court cost, etc. totalling $12,941.00. I never received a summons or anything. I haven't lived at that address for 10 years. They sure found me now that the court date passed. I dont know what to do. I'm paying just over 2,000.00 mo in child support thur garnishment already, and barley getting by. Any advice would be greatly appreciated. thx


Aolso if you already have a garnishment in place for your child support they are likely out of luck as far as you are concerned. Reason is that they maximum garnishment per federal law is 25% of your "disposable" income. Some states reduce this amount further but the absolute max of ALL garnishments is set at this.

So they cant for instance set aside your previously places support garnishment and take their share. Garnishments "get in line" for lack of a better word like most Liens do.

for instance if your current garnishment was 20% of your take home pay the MOST they could get would be the unused 5% allowed by law.

If Soaps excellent advise above doesnt get you anywhere (and depending on the judge it might not) make sure they dont attempt to take more out total than they are legally allowed to do.
