I sent a DV letter in April to CAVALRY PORTFOLIO SERVICE and they never responded until yesterday. I copied the pdf that was sent via email. from what I have read this does not validate the debt. I looked at my husbands credit report and Cavalry is showing on the report. with the collection history of May 2010 to July 2010. In order to validate a debt, a CA should send the following documents while answering your DV letter. These are a written proof that your debt is assigned to the CA signed by the original creditor, a copy of the original contract with your original creditor or account statements from your original creditor and a statement of your payment history till date stating your debt and how it is calculated till date. Since, as you said, Cavalry has not sent any of these, go forward and dispute the debt. Keep me posted.

wow, thats a big violation of the FDCPA.

before this goes any further, Mary, go to www.naca.net and look for a consumer attorney in your area. As long as you still have proof of your validation request, you are good to go. Many of those attorneys will give a free initial consultation, and many will also work on contingency basis if you sue Cavalry....which means you wont have to pay legal fees because they get it from Cavalry.

You will need the proof that you sent the DV letter, proof of when they received it, your credit reports showing that they reported the debt on their all those months AFTER getting your DV request, and the email showing the date that they finally responded to your DV request. And no, that isnt even proper validation of the debt anyways. But as long as you have the documentation I just mentioned, you look to have a solid case.
