I am being called everyday on my cell phone about a 10 year old debt that my wife incurred long before she ever met me. I married her 15 months ago. What can I do to get them (Midland) to stop calling me? I have given them additional contact info and they just keep calling my cell phone. I have told them I will file harassment and to stop calling and they told me they will not stop calling me.


Send a DV letter and include a full cease and desist with it. Send it via registered mail. When the green card comes back, record any call they make along with the time and date and file a suit for FDCPA violations. if you live in a 2 party state make sure you make them aware of the recording. In addition you should pull all 3 CRs for both you and your wife to see if this debt is on there. Since the debt is 10 years old it should not be reported. In addition, it is probably outside the SOL. You can sue for FCRA violations if any of these are occuring.

You could also consider changing your phone numbers. I would not provide them with any other contact info. I have not given a working number to any place of business in years to keep collectors and sollicitors from calling me. This includes legitimate business aswell like banks or any other business that asks for my contact info. I don't want them calling me for any reason and I don't want my number shared or sold.
