CACH LLC No License in FL

I was sued by CACH LLC back in 2007. I agreed to make payment and have been on time with every one. Only 4 more payments to go. After finding this forum and doing some research I found out that CACH is not licensed or registared as an out of state consumer collection agency in my state (FL) as required by law per the FCCPA. Can I demand my money back or, take them to court? After they send me a PIF letter of course.


truthfully, if CACH was the plaintiff, then yes, they most definitely did violate your state's laws. I dont think anyone can disagree that a civil suit by a debt collector is most definitely collection activity....and since that debt collector needs to be licensed in your state to perform any collection activity legally there, it can be argued that they unlawfully sued you. While it is true that the attorney is the one that actually files the suit, it is the plaintiff that directs the attorney to do so. If CACH was the plaintiff in your case, I would contact your state's attorney general's office ASAP....they may not be much that they can do or that they choose to do but I would at least give it a shot. Keep in mind that it doesnt change the fact of whether or not you owed the debt, or if you are responsible to continue paying it.
