I DO owe an amount to Sears, I disputed $300 of a 1200 bill with them. They did nothing to fix it. So I quit paying for a while then a new rep promised to help so I sent in a token amount, they again did nothing and turned me over to UCB. I AM NOT trying to be a deadbeat. I DO want to pay what I owe, but no more and can't pay off in full now. I have had several harrassing phone calls from them, was sent a privacy notice but NOTHING else. They even called my grown daughter who lives with her husband! They gave me ffake names, one idiot even gave me two names during the same phone conversation. They all wanted my banking info which I refused to give to someone over the phone, then they got NASTY. Told me I was a liar, they were going to make me pay, sue me, etc.
I had to hire an attorney, who sent them a debt verification request and for one week all has been quiet.
I have many questions.
What can I expect now?
If the card was in my name can they garnish husband's checks (I'm a stay at home)
Can they freeze my checking account like they threatened?
What happens if I am not notified of a court date? I only have a PO Box listed for me.
We had some financial issues and are trying to get back on our feet, but there really was a charge made on our card (to Wisconsin, we live in Midwest)
My attorney doesn't act too concerned but this is new to me.
Please someone give me some advice.
Thanks.

Do not get scared over a $1,300 debt. Your attorney should answer these but sure he will charge you. They cannot call you again until debt is validated, if they do write everything down. If card was only in your name they cannot touch husbands check. Unless you are in community state (look it up).

They cannot freeze bank account unless they take you to court and win. If you are worried about bank account make sure only in husbands name. To take you to court I beleive they must pesonally serve a summons, although I have heard of some sneaking in without someone knowing.

I really would not worry so much since you have a lawyer. Hard to beleive they would take you to court over this amount. They are breaking the law by harassing you and you should tape calls and write down everything they say.

Really, you are wasting a lot on an attorney who cant do anything for you could have done yourself. UCB probably had the account assigned to them by Sears....they cannot sue and do not sue. And they may or may not validate. More than likely they will close it and it will go back to sears and be sent to another agency or law office. Then the cycle starts all over again

Big issue here is the balance you are not disputing. That is what a judge will ask...
