Pay Day Loan Yes Loans in Illinois

Good Morning,
I have received a call from the Illinois Dept of Financial Institutions and they have asked me about paydayloanyes. I guess they were sued by Illinois in 2007 and were to never loan to people in Illinois again. My husband received a loan from them 2 months ago and since then we had to close our checking account. They call him at work and tell him he is going to jail and they swear at him. I sent over the Cease and desist letter and they called him immediatly and said that piece of paper means nothing to them. So what i am asking is Is there anyone else who has a loan with them that live in illinois and is having the same problems. This gentleman would love to hear from you,sounds like he wants to take them down? Let me know.....:p


i dealt with these bastiges in the past,and the law means nothing to them.you are right,they were not only sued,but fined 275,000.00.so yes if anyone in our state of IL has or has had a pdl with this bottomfeeder.file the complaints.not only with the DFI,but our AG ms.madigan.she is the one who put the wood to them in the first place.

I LIVE IN KY AND I AM HAVING PROBLEMS WITH THEM, THEY CONSTANTLY CALL MY JOB AND MY REFERENCES AFTER BEING TOLD BY MY SUPERVISOR AND MYSELF VERBALLY AND IN WRITING BY FAX AND BY EMAIL TO NOT CONTACT ME ON THE JOB. I TRIED SENDING A LETTER TO PHYSICAL ADDRESS BUT IT WAS RETURNED. EVERY TIME THEY CALL I DO NOT ANSWER. I SEND AN EMAIL TO THESE EMAIL ADDRESSES FOR THEM: PAYDAYLOANYES" , [email]cs@payday-loan-yes.com[/email], [email]concerns@payday-loan-yes.com[/email], [email]ceo@payday-loan-yes.com[/email] STATING THE FOLLOWING :

"THIS IS HARRASSMENT AND IT IS ILLEGAL. THIS IS THE 2ND TIME I AM SENDING THIS EMAIL. IT IS AGAINST THE LAW FOR YOUR COMPANY TO CONTACT ME ON MY JOB WHEN IT HAS BEEN VERBALLY INFORMED AND IN WRITING. I AM FILING ANOTHER COMPLAINT WITH THE FTC AND THE ATTORNEY GENERAL.

PER THE FTC, FAIR DEBT COLLECTION PRACTICES ACT,
Section 805(a)(3)). Debt collectors may not call you at work if they have reason to know your employer forbids such communication (e.g., you or your employer has verbally informed them).

MY SUPERVISOR HAS REPEATEDLY INFORMED YOUR COMPANY NOT TO CONTACT ME AT MY PLACE OF EMPLOYMENT. YOUR COMPANY HAS ALSO BEEN INFORMED NOT TO CONTACT ANY OF THE REFERENCES LISTED. I AM DOCUMENTING EACH CALL TO MY EMPLOYER THAT I HAVE RECEIVED SINCE JULY 2, 2010 WHICH IS THE DATE THE REQUEST WAS FIRST MADE TO STOP THE CALLS. THE FOLLOWING STATEMENT IS THE ORIGINAL REQUEST FOR MY PLACE OF EMPLOYMENT NOT TO BE CALLED, REFERENCES NOT TO BE CONTACTED AND FOR ANY COMMUNICATION TO BE MADE VIA EMAIL OR US POSTAL MAIL.
THIS WAS SENT VIA FAX, EMAIL, AND POSTAL MAIL IF I WAS ABLE TO FIND A PHYSICAL ADDRESS FOR YOUR COMPANY.

I CHANGE THE DATES ACCORDINGLY. THEY STOP CALLING AFTER A COUPLE WEEKS, THEN START BACK. I HAVE RECEIVED THE THREATS OF COURT, BEING SERVED ON MY JOB AND I CALL THEIR BLUFF. UNTIL I RECEIVE SOMETHING IN THE MAIL FROM AN ACTUAL COURT OF LAW I WILL NOT AND I REFUSE TO DEAL WITH THEM.

FYI, The FDCPA does not apply to the original creditor, it applies to third party collectors, check your state laws.

Sometimes they say pdlyes and other times its global, or first national. I am aware of the laws in ky per this site and sent letters using the sample i got from here. Either way, per the ky state atty general all online pdl's are illegal in the state of ky. This site is a great help. Thanks and keep up the great work.

mr mergel, i have a question regarding wage garnishment. I live in the state of ky, can paydayloanyes contact my job for wage garnishment?? I've already closed my accounts and sent out the sample letter i got from this site, i asked them to not contact me on my job and my supervisor has done the same and they continue to call. Today "karen lamb" of first national which is pdlyes called asked for my supervisor to get my employer address for wage garnishment. What should i do next?

Not a garnishment, but yes a 'wage assignment', however, if you sent them a sample letter from this site a wage assignment revocation was already in that letter, so, print that letter out and take it to your employer, this way if a wage assignment request is made to your employer they will have no other choice but to deny it, as wage assignments are voluntary and can be revoked at any time. A garnishment is a different situation, but it can only be obtained with a court order and I highly doubt that paydayloanyes would have the nerve to walk into a court room, and even if they did there would be a multitude of procedures they would need to go through before it ever went to court, and due to the fact they are an illegal lender your case would be open and shut anyway.
