Ive read from another post somewhere that East Side is a licensed lender in the State of Delaware. Where do I find the licensce number etc???

Not if your state prohibits pdl's or requires a licensing in your state, no.

Then you are fine. Eastside Lenders has been licensed in Delaware for quite some time now, but they are known to issue loans to non pdl states, the problem is, a lot of people are unaware of their state pdl laws. Eastside lenders are also notorious for using the excuse "governing law", or "world wide web laws", but it doesn't amount to a hill of beans in actuality.

Ok thats what I thought. I dont get it though, how does the State of Delaware allow this kind of lending????? If they are licensed arent they regulated??? I issued ach blocks to my account orm them and put a request for a month worth of payments. We will see what happens. I am actually putting together a letter right now for the Delaware AG and the Delaware Department of Justice.

Then it's the bank's error. They should reverse it and any fees incurred because of it.

This is why we tell you to close the account. I know you have the "husband thing," but, as I mentioned to another poster just moments ago, you should really just talk to your husband. Get it all out in the open and deal with it. You imaginings of what might happen are probably overblown. He may be angry, but he'll get over it. Imagine the burden and stress you'll relieve when it's all out in the open. Everyone makes mistakes, right?

Well I know it would be amazing to be free from the stress by telling my husband...however he doesnt get over anything and is a very angry, unforgiving man!!!! It would be great to be able to confess and alleviate the burdeon but its not in the cards. He is angry and unfrogiving on a daily basis, without this financial burdeon which is elevated because I am unemployed and have been for quite some time. For him to learn, that I have wasted sooooo much of our families money, our childrens money so foolishly would be unimaginable stress. I wish I was over imagining his reaction, but after 17 years of marriage....I know him! But I appreciate your advice just have to handle this differently.

I totally understand where ballplayersmom is coming from. I feel that since I made this mess, then I need to clean it up...which I have done...very, very slowly, but I'm getting there. When I look back and total up the amount of money that was spent by rollovers and paydowns, it just makes me sick. But I have to move on from that and realize that I have dug out and my paychecks are no longer being eaten away by PDL's. The light at the end of the tunnel is within reach now.

Me too!!!! But it has gottne better...Like I said I had 15 and now have less than 5... So its improving slowly...But Eastside is a tough one....Actually sent off 15 more emails off to them this morning....That is what I did with Loan Point USA, Upfront Pay Day and MyCash Now and all provided me refunds. I just keep resubmitting, I want someone to listen to me!!!!!!

Eastside will not listen to you no matter how many e-mails you send them. If they don't get any money, they will turn it over to a collection/lawyer. I went round-and-round with them last August/September, but I had closed my account before sending the ACH Revocation letter. You could contact the AG in Delaware and see if they can do anything, copying Eastside on your complaints. I would also think they are illegal in continuing to debit your account.

I had a collection agency do that, and only when I closed the account did they stop.

Again, I had the same issue with ESL. They completely ignored me. They did NOT, however, ignore the BBB of DE. They sent the BBB a letter stating they had marked my account as PIF. The BBB sent me a copy of that letter. ESL then turned my account over to a CA and when they called, I simply emailed them the PIF letter and told them they should tell their client to check their records. I've not heard a peep since.

Ohiogal, I just received the same email from the DE BBB!!! Eastside told them that they have issued me a PIF...however when I go on their website it still shows an active account. I followed up with the BBB an told them that although they told them that my account was marked PIF it still shows active and that I am seeking a refund of $2000 to settle this account.

Well I certainly do not advocate not telling your husband, but I definately understand when you can not!!!! I have found many people who are in our situation, and it definately complicates things! I have actually even made a very good friend who shares my same story and we have become friends even off of this website. Ok now here is the latest...Go back on my account and see that they have wiped out my balance....BUT they now have my account listed as in collections because the last debit was just returned. So now it says collections balance $162.50. What do I do now????? I am so flippin angry!!!!! I overpaid these suckers by ovever 2000 and they have the gaul to my account in collections when I told them to stop debiting. I want to call!!! What should I do???????????????

Hang onto that letter. They will, at some point, sell it to a CA. They are all about money, right? Anyway, they sent mine to Alliance Asset. The gentleman (Mr. Garcia) copped an attitude with me when I told him this account was already paid in full. I asked for his email address and sent him a copy of the letter and asked him to acknowlege receipt of the letter, stop all collection efforts and send me an email stating such within the hour. After 3 hours passed and I hadn't heard from him, I forwarded my email to the President, Operations Officer and Client Services Officer. All 3 responded within minutes and apologized profusely. :) If they send the same bunch after you, let me know. I'm happy to share contact info.

I'm not sure there's much you can do to get your refund.

well they wiped out the remaining balance...or so she said. right now the website does say zero. but she would not send me a pif email...she said why would I? I said why wouldnt you? she said because u didnt pay your debt we just eliminated it. i told her i recived a pif through the managers name at eastside lenders she said that is ur paid in full we wont send you anything directly. so then i said i paid 3000 on a 700 loan and she said yup thats about right. i said really seems more like extortion and she hung up. im not giving up on my refund!

I would also like to assure you that your loan now has a zero balance. It
can take up to 48 hours for our system to update once an agreement is made.
We will not pursue any future attempts to collect this debt and you have no
financial liability with East Side Lenders. However, we are unable to honor
your request for a refund. The East Side Lenders loan agreement and website
contain all disclosures required by Delaware and federal law and make it
clear that all transactions are governed by Delaware law. East Side
Lenders is duly licensed by the State of Delaware to make small loans.

I think it's up to you. Either way it's a victory. They can't take back the PIF so, if you want to fight, do it. They know, however, that just as they don't have a legal leg to stand on, neither do you.

The only avenue you may be able to pursue is sitting down with a bank rep and figuring out exactly when the principal of the loan was paid off. Then, see if they can help you recoup any debits made after that date as unauthorized debits to your checking account.

Ho hum, I would definitely accept the PIF but would still push for a refund, in the meantime, I would over load the Delaware attorney general with complaints about this company, think outside the box a little, I bet you can come up with some ammo that might force some action out of the AG's office.

Well the BBB closed my complaint stating that they had issued me a PIF and thats that. So I sent of another packet to the Delaware Department of Justice, which I am unsure whether that is a seperate entity from the DE AG. I dont understand how they can allow this!!! Trying to find out who the CEO or President of Eastside Lenders.....Anyone???? Im searching for any ammo!!!

Well I pushed and pushed and pushed and I just got an email that I will be receiving a refund from Eastside lenders!!!!!!! Its a small fraction to what I paid them...but it is a refund!!!!!!!!!!!!!!!!!!!!!! This was the hardest one yet!!! So recap to date..... PIF notices and refunds from Loan Point USA, Kenwood Services, Upfront Pay Day, Eastside Lenders, and My Cash Now....all in a matter of 8 weeks!!!!!!!!! Again not big refunds...but refunds!!! YAAAAAAAAAHHHHH!!!!!
