How to answer REQUEST FOR ADMISSION?
Date: Sun, 08/22/2010 - 13:03
I am learning a lot from all of the resources here, so I am very appreciative of everyone that contributes, but I am still a little confused.
I was just served papers that I'm being sued by Equable Ascent Financial in Collin County TX. I'm not exactly sure how to "answer" the (17) statements listed in the REQUEST FOR ADMISSION section.
The credit card in question is still within the SOL, so I cannot use that defense.
An identical copy of my suit was posted by paintballrefjosh just recently, only the names, account numbers, etc. have been changed...so it looks like a boilerplate suit they send out. The amount is just over $5k on mine.
Here is the link to his blanked out copy which is just like mine: http://moahosting.com/downloads/pdf/lawsuit_original_petition_blanked.pdf
Any help on how to answer this would be greatly appreciated. I have to respond by late next week, so time is winding down.
Thanks,
MySuitDismissed (i hope)

Deny the ones that are untrue. Deny the balances. Some of the obvious true ones you must admit. Don't lie in court proceedings.
I would consider hiring an attorney. Or maybe contact their attorney to settle this now if this debt is legit. Offer 30% and go from there. They should settle for 50-60%.
Make sure you answer the petition (or have an attorney answer for you), otherwise they will get a default judgment.
The good news is since you are in Tx, they can't garnsih your wages if they do get a judgment.
