I am in need of some advice. My boyfriend has a credit card with Washington Mutal (Chase), he has had this card for 6 yrs +. He lost his house and has been having troubles with this card.He owes $4,500. He has been making small payments, but they closed the account and sent it to collections. I just got the letter from the collection company friday, and received a call from them friday. For one they spoke to me about the debt and we are not married, second they told me they spoke to my boyfriend which they had not. So they offered me a settlement of $2,000 and wanted it payed right then, when I tried to tell them I could do so but not till the end of sept the manager on the line got realy rude, told me if I would pay my bills I would not be in this spot. Told me either I pay now or else. I told him I have rights and his treatment was wrong. He then started telling me he was going to tell his cleint we were refusing to pay, I told him no we are not but can not afford to do so till next month. He then demanded to know where I would be getting my money from. At this point I asked for a manager. He then put my call back in the collection que. I need some advise on where to go from here. This was crazy. He would not even give me time to think.

What steps do I need to take now?
Any help is greatly needed. I am getting scared


You have not mentioned the CAs' name. I think the account is not sold to the CA but has been assigned to them. If the CA threatened and cursed you (as you have written), then they have violated FDCPA rules. You can file cases against them with the FTC for this. I think you can contact WAMU and ask them if your account has been assigned to this CA.

Anyhow, you can tell them about your position and also state that you all are really interested to pay off the debt. In any case, if the CA is eligible to collect your debt, you have to pay the debt.

The company that called me is National Establishment systems. NES. Very rude. Kept telling me I should have paid for what I used. I dont mind paying it and is more than willing to do so, but what to work out payments, but everytime I tried they kept saying I was refusing to pay

You have 30 days time to dispute a debt from the day you receive the collection letter. I'ld suggest you to send them a DV letter via CMRRR immediately. As per FDCPA, the debt collector can't collect on the debt till they validate it. So, it will give you time to arrange for the payment if the debt is validated.
