I am working with a consoldation company, they said they need a $100.00 processing fee before they start. Which I am willing to pay but I need to know if this is the option I need to use or if I can do it my self, I have already closed my account and opened a new one with the same bank and I have told the bank the honest truth about my situation. The consolidation company has told me not to contact any of the lenders and let the consoldation company do the talking/writing. I am not sure about the laws in MO, nor do I have any information on what can happen to me. I have every intention of wanting to pay the loan companies their money, They just take my whole check and I cannot afford it anymore. I was left with no choice!
I have 4 PDL's
cashnetusa $268.75
checkintocash $360.00
paydayloan yes $390.00
and E payday $350.00
all interent loans!

Please advise!

I don't know why anyone would pay a debt consolidation company to do, what you can do for yourself FREE. Not only that, but two of those lenders you have are ILLEGAL. So negotiating with an illegal lender is NOT an option, even for a professional company.

You can NOT trust ANYthing an illegal lender says.

Cashnetusa and Checkintocash both offer an extended payment plan, all you need to do is ask for it.

Paydayloanyes isn't even located in the U.S. and they are more crooked than a dogs hind leg, don't pay them anymore than what you borrowed, they are not entitled to interest or fees because they are NOT licensed! They might even owe YOU money if you overpaid them.

E Payday, are they also known as Paydayone, if so, then they also offer an extended payment plan. I need to know if E Payday has another name.

Notice that your results all had something that ended with the letter "E" followed by payday - meaning they weren't necessarily affiliated with the lender the OP has had dealings with in any way.

This is the letter I sent to E pay day

This letter is to inform you that I am aware of the FACT that the loan you issued to me, is NOT legal or binding in my state. For your convenience, I have included my state payday loan laws below.

Otherwise, interest is set pursuant to small loan law which provides that parties may set rate by contract.) Finance Charge for 14-day $100 loan: $75 APR for 14-day $100 loan: 1980% Debt Limits:
Maximum Number of Outstanding Loans at One Time: Not Specified Rollovers
Permitted: Six (borrower must reduce principal amount of loan by 5% or more upon each renewal) Cooling-off Period:
Repayment Plan:
Collection Limits:
Collection Fees: NSF fee; Collection costs (including court costs and reasonable attorney's fees) Licensee cannot use a series of ACH transactions to collect a single check.

The state of Missouri requires Internet payday lenders to be licensed in MY state. I have already researched this information, your company does NOT have a license to lend in the state of Missouri if I am mistaken I will need proof in the form of a license number so that I may verify it with my Attorney General. I am bound by the state laws where I reside. As I have no presence in your state therefore I have no legal obligation to the 'governing laws' you may have detailed.

Be advised that as of today August 25, 2010 I am revoking ANY and ALL ACH authorizations with your company from debiting any AND all of my personal accounts, per Federal law, Regulation E Section 205.10 Preauthorized transfers. I also revoke ANY and ALL wage assignments I may have signed, by you, including but not limited to; any of your affiliates, dba's, and collection agencies assigned to this account. None of the above no longer have my permission to access my accounts or impose a wage assignment.

I will only communicate to resolve this matter via email. If you ignore this notice and attempt to contact me or any of my references via telephone, you will be ignored and any payments owed will be delayed. I am willing to pay the principle amount of the loan only, however, no address means NO payments, this is not negotiable.
If you do NOT reply to this notice within 48 hours I will be forced to file complaints with my Attorney General Chris Koster, the BBB and the Federal Trade Commission. If you reply to this notice with any misleading legal implications or menacing course of actions you are unable to follow through with, I will be forced to take actions against you which could cause you to lose your license in the state of Elkins Park, PA (Cash Net), Wilmington, DE (Global Financial), and Global Payday Loan (Salt Lake City, UT). and cause damage to your reputation, which could potentially decrease your clientele!

Sincerely,

Response from Eastside Lenders. I wanted to get some of my money back they are paid in full.

East Side Lenders is responding to your correspondence regarding the above-captioned account.
East Side Lenders, which is located in Delaware, is licensed by the State of Delaware to make small loans. All such loans are approved and funded in Delaware, with repayment to be made in Delaware. The East Side Lenders loan agreement and website contain all disclosures required by Delaware and federal law and make it clear that all transactions are governed by Delaware law. On the advice of counsel, East Side Lenders maintains that the choice of Delaware law as controlling in the loan documents would be upheld, as all of the significant contacts in the loan transaction occur in Delaware. The loan agreement is legal and enforceable. In responding to your correspondence, East Side Lenders notes and reserves all available legal and equitable objections to the points you have raised.
East Side Lenders provided this service as a convenience to you. We still consider your loan to be outstanding and are prepared to go to arbitration as provided for in the Loan Agreement between us. As an alternative, if you are experiencing financial hardship, we will be happy to speak to you about payment arrangements through which you can successfully meet your payment obligations. East Side Lenders will consider doing so because of our continuing commitment to servicing our customers and not because of a legal obligation to do so.
Should you have any further questions regarding this matter, if you wish to speak about payment arrangements, please contact us at (800) 689-5603.
Sincerely,
Customer Service

I live in Ky & internet PDLs are illegal here. Do not spend $$ on the consolidation stuff- you can do this yourself. These illegal PDLs do not have a legal leg to stand on & they know it- so they rely on scare tactics. You did the same thing I did--closed you acct & know that you are in the right- they are not. Good luck.

This is the reply rom E payday
Ms. XXXX,
I apologize for the delay in this response. We would be happy to close out your account and provide you with a paid in full letter. However I am unsure if we will be able to refund you any amounts owed since there is still a balance. Please advise me of what type of refund you are requesting and I will see what I can do for you.
Thanks
Mr. Jordan

I have a paid a total of $645, I am just not sure if the loan was for 300 or 400 and I already look stupid enough for getting a loan in the first place and then have to ask them how much it was for is beyond ridiculous =( HELP should I just say the fee's and charges that were assessed after the amount was paid needs to be refunded?
