My husband had some payday loans out, but there was a discrepancy with the amount owed. I wrote them asking for verification of payments....never received anything from them. I wrote letters several times asking them to stop contacting references or employers until I receive the amount owed. They kept calling and now he got his check with 300.00 deducted from it. No notification from employer or PLS. He doesn't even know how the amount was calculated and for how long. He called his payroll department and they said they have a legal document from the state of Illinois for wage assignment. Can this be done? All as I wanted was verification of payment which they did not supply and now this. It just doesn't seem legal. Would he not have to go to court if it's a legal document, and should he not get some notification from somebody? Please advise me on any recourse I may have. The company he works for is a big company, so I am sure they know what they are doing. My husband did sign at the time of the loan about a wage assignment, but then he received something if he does not authorize the wage assignment sign it and send it back. Also, in my certified letter I did state no wage assignments can be taken unless they get a court order, or supply me with proper payment history. Hope this all makes sense just need some help!!!!!


Many PDLs have you sign a wage assignment at the time the PDL is taken out. These are voluntary and can be revoked at any time. You need to give a copy of your certified letter to his payroll/HR department. If it's dated prior to the date the money was taken from him, you may be able to get it back.

What PDL company is this? How much did your husband initially borrow? How much was paid back (total of debits)?
