HELP!!! I have 3 PDLS and need to know if they are illegal and unlicensed for California?
Date: Sun, 08/29/2010 - 17:47
I live in California and currently have 3 PDLS. I would like to know first what the PDL loans law is for Californi and if the following PDLs I have (listed below) are illegal and/or licensed for California or at least if you could point me in the right direction to find the answers to these question:
-First Bank of Delaware aka fbdloans.com aka ThinkCash(I believe this is an actual bank. This is my second loan with them. The first was for $500. I paid this off totaling over $1150)
My current loan with them was for $600. To date, I have paid a total of $547 so far.
*Are they licensed and legal in the state of California?
-I also have a loan with Extra Cash Live for $500. To date, I have already paid them $500. The finance charge is $30 per $100 balance. The principal remaining is $450 and current finance fee is $135...
*Are they licensed and legal in the state of California?
-I also have a PDL with DollarFlash for $500. I have not paid anything on this yet as it is was recent (less than 2 weeks ago) but only want to pay off principal if they are illegal and unlicensed as well.
*Are they licensed and legal in the state of California?
Please advise and thanks again for all you are doing...

Thanks Shazzers. I checked out the links you sent and it looks like the other 2 companies are not licensed and illegal in California according to California Pay Day Loan laws. I have read different posts on how people go about with a C&d letter but the info I read is scattered around and hard for me to understand what to do going forward from start to finish. Please advise if you have a list of things to do in regards to sending the PDLs a C&D letter and what to do next. I have no problem with paying the principal back as with one them (Extra Cash Live) I have $50 left to cover principal however, my other question is that if these companies operating illegally in the first place, does that make the whole contract null and void, releasing my obligation to pay even the principal? Just curious as I do plan to pay the principal amount but am curious son how that works and if any of your members have been successful in enforcing this...
Thanks again...

Hey Shazzers,
I got a call today from someone claiming to be an attorney from Baker & Associates (Robert) phone number 1-877-410-0612, regarding a bounced check across state lines. I looked up this number and looks like others have received the exact same call and message: http://mrnumber.com/1-877-410-0612?submitted=y,
The message demanded that I call within 24 hrs or else they will pursue to serve me papers. when I called, the guy on the line was very rude when I asked him what this was in regards to. He said, that it was regarding a Pay Day Loan that tried to collect money from my bank but the bank account was closed. That was it, no details on the name of PayDay lonas company, et. He then asked me do I wish to pay it through their office or get served to go to court. I told him that he needed to elaborate. He didn't budge. I then had to ask him specifically what pay day loan from who, the date, the amount, etc. He was very irritated that I was not intimidated by his threats and here is the info he gave me:
Name of Pay Day Loan company: DMG Financial (never heard of them and did not find any payday company by that name)
Amount of transaction: $300
date of transaction: 6/18/2010
After I asked him these questions, he answered and he hung up.
I followed your advice last summer and sent a cease and desist letter to 2 payday loan companies who were not legally authorized to do loans in California. These companies were:
Extra Live cash: Loan $500 I paid them back exactly $500 and sent them a Cease & Desist letter and closed my checking account
Dollar Flash: Loan amount: $500. I sent them a Cease & desist letter and offered to pay them what they deposited only if they responed in alotted time. I also threatened to report them for offering loans illegally in California as they are only authorized to do loans in utah (closed my checking account) I did not hear back to them.
I have never heard of DMG Financial and could not find any reference to this company associated with payday loans. When I checked the date that they gave me, Dollar flash would have been the closest to that date of 6/18/2010 however, that loan started in 08/2010 and that was for $500, not $300 that this so called attorney claimed.
So these things are not adding up at all. What do you recommend I do moving forward? If it is one of these companies that I sent a C&D letter to, disguised under another name, what is my defense?
Thanks Shazzers,

well let me chime in as the idiot from the alleged attorney broke the law with his message.every illegal lender, and collector of illegal loans uses the "bad check"threat.he hung up because he didn't get what he wanted.basically the threat of court is a scare tactic and you also didn't budge and just pay him.file a police report as again the threat was illegal, and i'm guessing this law firm is a made up entity of one your illegal loans.you see alot of illegal lenders are affiliated,or have more than one d/b/a so DMG could be another d/b/a of an illegal lender.file the report,as well as AG,AND FTC complaints using the number and name of this supposed law firm.then when he,or another mope calls from this place state.
i'm not just paying a voice over the phone under any circumstance.send me something in writing,or sue me,but i'm talking to you again until i receive it.hang up,and don't hold your breath waiting for something.just know what this guy did with the threat is illegal.

Thanks again for your promt response and diligent answer. I really appreciate this forum and mediums like this to assist the consumers. It is ashame the tactics these collectors, PDLs, etc do. how do they sleep at night? You are right in that, most people when threatened buckle and these snakes know this. I will file complaints against this group as mentioned but some of the true tellers of it being bogus was no detailed information, the person on the phone said bad check across state lines (i dont have or write any bad checks, esp across state lines) with my bank. the voicemail sounded like my bank was in the process of suing me for bad checks across state lines. Then the shortness and rudeness and no information. I had to pry the info from him, none of it being correct or accurate...
How low these snakes will go. Anyway, thanks again paulmergel. I will definitely follow suit and file the reports.
