I live in Texas and got way in over my head with payday loans. I've paid some off, but I have defaulted on the rest and closed my bank account. I hired a Payday loan settlement company who faxed cease and desist letters to them all, but the lenders are still calling and harrassing me and saying they will not work with the settlement company. The settlement company says that they will all say that and to ignore them and not take thier calls and to let them (the settlement company) deal with them. I'm confused as to who is telling the truth. Should I beleive the settlement company when they say to ignore the calls and that the lenders will work with them, but they try to tell you that because they can get more from the consumer than the settlement company? Has anyone used a settlement company and had success?

Original creditors are under no obligation to abide by a cease and desist unless state law requires it.....the FDCPA does not apply to the OC. Also, debt management plans are done in "voluntary cooperation"...no creditor can be forced to enter into a plan.
