A month ago I started moving all of our deposits to another bank. If a deposit came through I was up at 3:30 in the morning moving it to another account that my account was linked to. Friday's deposit came through and I had no clue that it hadn't moved to the new bank.

At the beginning of the month I did the following. I used the letter that was posted here and requested that they stop debiting our account. I received a letter back telling me that they would. Then they called my job where I concisely and professionally told them I would not receive calls at work which was stated in the letter I sent them. The calls to my job stopped. One of them said they would not honor the letter. that they had every legal right to debit/ach our account. The other loan offered me a repayment plan. I realized I had paid them 4000 illegal dollars. I emailed them back and told them I would be happy to speak to them about a repayment plan for what was illegally taken from me and how they could return my money. I have yet to hear from them again.

In the meantime speedycash who agreed to no longer debit our account started trying to debit our account 2x a week. The other one started trying 3 different amounts once a week.

So friday a deposit came through and everything was gone and speedycash was getting our house note. My husband (the good soul that he is) went to the bank armed with the letters we had written and the responses we had been sent. Sat down and spilled our guts (I had called the branch we set our account up with and the customer service line weeks ago and was told that basically I got myself into this mess get myself out).

Well not so - the customer relations rep and the Ops manager took over on friday and shut down their debiting our account, refunded the money they were going to steal on friday and the best thing gave us a new account. We had been with this company for 10 years we didn't want to leave.

I'm still fighting them, but they have us in a collection agency now. As I keep telling them show me some proof you are a legal lender here and I will talk about paying you. In the meantime I feel like I've paid them enough in the interest to cover the loan.

So thank you very much for the help that I received - by lurking (I spent 4 hours one sunday afternoon reading and re-reading and then tailoring the advice to our needs)


I am glad that everything is working out in your favor, just keep your chin up and stand your ground, as long as you are following the law you will be fine. Regarding the collection agency, the next time they call you tell them they have 5 days after their first initial contact with you to send you a dunning letter (letter of collection) through the mail, that is a federal law (FDCPA).
